West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

Does anyone know if there was any additional articles or letters in the financial press over the weekend about the West Bromwich Mortgage Company?

I wrote and emailed a number of papers but I didn't see anything.

I also wrote to my MP and another number of MPs in the areas of my properties . The only replies so far have suggested that only my MP can take this up. So I would urge everyone , not just those effected by West Brom, but who have buy to let mortgages with any provider to drop a line to their MP and to the press.

I think the more people kicking up a fuss the more pressure that can be put on West Brom.

In addition I watched Watch Dog last week. They ended with a short piece on Clydesdale Bank. They have been fined millions because they tried to recover genuine amounts owed to them by customers. The error was Clydesdales, so they were fined because they put their own commercial interests before that of their customers.

Isnt this exactly what West Brom are doing ?

Again the more people emailing Watch Dog the more chance of it being broadcast the more pressure put on West Brom. watchdog@bbc.co.uk

In addition to Watch Dog, it would be useful to try and get Radio 4's Money Box programme onto this - if only to alert other West Brom customers that there is action afoot.

Mark, as mentioned previously, all our documentation is in boxes following a very recent office move, so it will take us a few days to go through and find it all. Can we send our cheque with details of the account numbers and follow up with paper work shortly? Also, although we registered as a participant in the claim at the very beginning we haven't received any email direct from Justin yet. Have we missed something? I want to send the chq but don't have any details.

I agree about lobbying your MP

I have done this with several , see separate posting. Unfortunately it seems that you can only lobby your own and not the MPs where you have properties or the MPs in West Bromwich. So if everyone who has a Buy to let mortgage with any company lobbied their MP , especailly if you are in West Bromwich this has to help. For the sake of a letter and first class stamp it has to help.

Contact the PM and Chacellor too !!

It would be just great Annette if WB savers closed their a/c's in droves especially those with large amounts. Would definitely hurt WB and make them sit up. But just how can we possibly bring this about? Contacting media etc maybe but who is going to do it? If WB savers are content now with the returns they are getting, are they in reality going to close their a/c's anyway on a lofty point of principle because of the manner in which we borrowers are being treated?

I say crack on with what we can do and influence namely the action. Perhaps when this gathers steam savers might then start to take note?

Mark, I think it would be useful to give an update of how many have signed up/amount received on this forum to reassure those who are contributing and also to motivate others to do likewise.

There was included in the post from Justin inviting us to send docs and payment a statement that he would be updating us as you suggest. Doubtless this will be via this forum. Due to folk taking time to find docs in their archives etc maybe the update won't be forthcoming for at least a couple of weeks?

Some of us are calling the WB rather a lot - I would suggest you use their Free Phone number - every little helps!
0800 - 2980008 (Option 3) - gets through to the same place as their 0845 number.
Rather they get the bill than you 🙂

Annette, I think you have highlighted the difference between a publicity campaign and a legal challenge. In the first you need a single issue that people can understand and relate to e.g. the fact that WBBS are determined to renege on their original offer and increase the differentials as and when they choose. This could really damage their credibility with their existing and potential customers. In the second case it is essential that every point is taken - there is no telling how a court will adjudicate on each one.so everything has to be put in the pot.

Ivan, there was discussion early on about the 1999 regulations and it seems likely that WBBS take the view that BTL landlords with multiple properties are not "consumers" within the meaning of the regs. No doubt counsel will deal with this issue in his advice. Another matter that might have to be addressed at some stage is what happens if it is decided that some of those affected are "consumers" but others are not, depending on their individual circumstances.
