Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

Hi all,

Sent off my letters to the WBBS over the weekend and today have sent letters to our local MP both at his address locally and at the House of Commons. Will let you know what the MP responds with if anything. Also going to send one to our MEP also.

Plus Im going to do what someone on here suggested and write to the PM & Chancellor too.

In addition I though about the Bank of England themselves as they are the ones who have set the Base Rate low so that the country can recover from the crunch etc

I know people on here have had the letters back from the WBBS with a final response on the matter but just wondered has anyone then sent them one back saying that they havent answered the specific points as I made sure I put in a few different ones from the template just to see if they answer them.

Does anyone think it might be a good idea to write to both the Chairman & CEO of the WBBS also ?

excellent idea about the ICO request. I'll send them a letter today.

My strategy when dealing with stuff like this is to waste as little of my time as possible on the subject whilst wasting as much of theirs as possible. Hopefully, just a quick copy/paste then 'send' by email.

For the avoidance of any doubt this is to include any information relating to me kept on computer or in a structured manual filing system or intended for such a system.

I have enclosed my cheque for £10 which, I understand to be the amount I am required to pay to you by law for a data access request. If you need any more information from me please let me know as soon as possible.

It may be helpful for you to know that a request for information under the Data Protection Act 1998 should be responded to within 40 days.

This reminds me of a dispute I had with a former employer. The dispute dragged on. They decided to settle when I requested copies of 4000 emails from them.

Could someone with legal background please look at the technicality of it all:

Product definition: BTL Life tracker, a variable rate which is the same as Bank of England Base Rate with a premium of 0.89% until the term end.

i.e. a variable rate = BBR (the variable) + Premium (the constant)

I really do not think that 'a premium' can be defined as a rate - it is a constant.

As far as I can tell from the members' postings, no where in WB documentation there is a suggestion that they can change this 'premium'.

I really think that on the basis of the mortgage definition alone, WB's case is doomed...

There is also perception of the word 'Life' - this word suggests permanency - here the life of the mortgage...

Yes I also suggested contacting the PM and Chancellor and have done just that . I think if as many people as possible also do that it wont help .

I also wrote to Mark Carney at the BoE as they are trying to undermine the rate setting he and his board sit every month. If all banks and BSs do this what will be their role?

I will update on here everytime I receive a response from anyone I wrote to , good or bad
