West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

we have today received a reply from Andrea Holloway, Mortgage Services sending us a photocopy of the information booklet in response to the template complaints letters sent on 25th Sept (I sent 2 one for the mortgage we have in our joint names and 1 for the mortgage in my own name only - response today is for the joint name mortgage)- . the brief note accompanying it offers no acknowledgement of our complaint or news about the other 2 documents requested (the offer letter signed by us and the mortgage deed) just asks us to call the 0845 number if we need any further information (well what about the other 2 pieces requested springs to mind). Anyone got any clues or advice about what we need to do next - or do we just hang fire.
Photocopied docs (although I really have located very few for the one in my name only at this point + cheque should be ready to post this afternoon

Apologies for keep bringing this up but I think that not only is a Legal action required against West Brom but as much publicity needs to be sort to create as much negativity against WB as possible.

I think you should re send your letters with a copy of their reply telling them its not a full reply to your request and that you do not want to speak to anyone on a 0845 number. Tell them you want a full written response as that will be the evidence you require when passing their reply onto the Action Group.

I would suggest you call them and write back in response to their letter asking them why they have not responded fully to your letter. I'd also send a copy of the original letter and their response and send it recorded delivery.

Re how West Brom has chosen who to target.
What is the understanding re the number of mortgages, and types of mortgages that we are supposed to have, before being targeted for the rate hike.

Posters have mentioned if you have 3 mortgages or more, then West Brom has has targetted you for the rate hike.

But is that if you have 3 "buy to let" mortgages and you have been targeted ?

Or, what if you have 2 buy to let mortgages (say 1 with West Brom) and a single mortgage on the house you live in - Are you also targetted on that basis ?

We don't know the answer to that question and WBBS have been very vague about their targeting. My best guess is that they will have excluded any mortgages on our own homes but it's just a guess.

There have also been several different messages given by their Customer services staff about how they obtained the data, The only consistent message is that it came from Experian, whether that was as a result of cross data referencing, credit searches at the time of application or new searches we don't know as different people have been told different things by WBBS staff.

I still say this is a red herring though, possibly perpetuated by WBBS staff posting here. We will never know for sure.

Is there any merit, and is it possible, to request a copy of all information the West Brom holds on each of us under the Data Protection Act ?

Does anybody have a template letter they have prepared we could use to make a "subject access request" ?

The Data Protection Act creates rights for those who have their data stored, and responsibilities for those who store, process or transmit such data. The person who has their data processed has the right to:

View the data an organisation holds on them. A 'subject access request' can be obtained for a nominal fee
Request that incorrect information be corrected. If the company ignores the request, a court can order the data to be corrected or destroyed, and in some cases compensation can be awarded.
Require that data is not used in any way that may potentially cause damage or distress.
Require that their data is not used for direct marketing.

It would be a "Subject Access Request" and costs £10.

It's a great idea John.

If we all do this it will annoy the hell out of WBBS. You think we have had a lot of photocopying to do? You ought to see how much work is involved in responding to a subject access request!!!

I did one once on BM Solutions and the papers that came back were 3 inches thick.

This is a great idea . If everyone did this for £10 can you imagine the stress it would cause the WB staff. There would be no one left in the office to provide the information .
