West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

Don't hold your breath Ruth. In the bombshell letter we were invited to call the WB Mortgage Team. I told them that i could not afford to pay, period, Help was offered through the Credit Team who called me back. The "question" they ask is "what is your rent on the property/properties with WB mortgages?". If the rents exceed the likely new mortgage payment leaving a bit of fat they say "sorry we can't help".

I replied "Since you are treating me as a multiple owner don't you think you should ask about other rents as well so you can judge impact of your action on my whole portfolio?". Credit Team are not told to ask and won't take it into consideration anyway.

They don't take rental voids or the need for occasional unforeseen expenditure on repairs etc into consideration either.

So the questionnaire you are being sent won't get you anywhere unless the rent's on your WB mortgage properties alone are low.

Hello,
New to this board, and holder of a small buy to let portfolio, with 2 West Bromwich mortgages.
Totally shocked by their decision to increase rates. Have not increased rents for 6 years, and seen no capital growth, yet costs, repairs etc. continue to increase.
These increases will seriously hurt us as we are not "fat cat landlords", just regular folk offering affordable rentals, trying to provide for our future.
Happy to contribute to the fighting fund, please let me know how and where to send funds.

I think the WBMC have seen a loophole and are seeking to take advantage of it at their customers expense. Pure greed. Happy to join any movement to fight the proposed increase.

The FCA has confirmed it will be entering discussions with the mortgage industry to address concerns regards recent high profile changes to the terms and conditions of tracker mortgages.

Does it sound like she maybe thinks BoI and West Brom have done it because they could - rather than as i believe they have done it done it by going against what is right and proper and they should ever be permitted to do - and it's a done deal??? I sincerely hope not

My understanding of this (having had to read ot 3 or 4 times to make sure of what they were saying), is that this women is warning other lenders not to follow the example/move by West Brom, using the reasons/loopholes they have used, as they won't necessarily be able to get away with it too.

They are NOT saying anything is done and dusted. It just means that other lender can't assume that they can just copy what these two lenders have done; and it's NOT saying that they are able to do this with impunity either! As yet it's unchallenged, but will soon be, if all goes according to plan.

I'm no legal beagle, so don't take my understanding as 100% - though I'm pretty confident my understanding is correct. Anyone care to disagree?

I would rather it said don't think you can get away with it 'either' rather than 'too' - but I'm probably (hopefully) just being pedantic (I am very worried, anxious, concerned and angry about all of this)
