West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

That is one of our major concerns. How legal is it for them to do this do a credit check without our knowledge or consent? John H

The first time I called West Brom to ask how they knew about my other mortgages they said they had carried out a credit search. I called again and said that they had no right to do this and was told at that point that they were using the credit check that was carried out when I applied for the mortgage in 2008! So it appears to me that they have changed their story.

I don't think it is legal to carry out a credit check without our consent. In addition I believe that it will leave a footprint on our ratings and it may also send out a signal to our other mortgage lenders who may wrongly infer that there is a problem which has prompted WB to carry out the check.

Mark, my wife is journalist and is willing to prepare something suitable for a press release. I suggest we ask people to volunteer to deal with their local areas (("Local Media Coordinators", if you like) and then create a list, so we are not doubling up. I will do Oxfordshire.
Once you agree the press release content, you could post it back on here for the Local Media Coordinators (!!) to cut and paste into an email which can then go to the editor of their local property pages. It can be top and tailed with a local interest angle - e.g. local people affected, etc.
Anyway, not trying to run your show - just a suggestion! (prompted by my wife, who knows how these things are done). How can we email you the press release draft?

PS a very good local angle in university towns, e.g. Oxford, where there are many BTL landlords and a high rental population of students, is how this will inevitably force rents up as leases are renewed.

Although I'm annoyed that the rate hike will see my mortgage more than double, I'm confused re the West Brom logic for the rate hike. The clause they are using is 5.1 (pg15) of the T&Cs. However, the BTL mortgage I took out wasn't sold to me as a product only for the professional investor with multiple BTL mortgages. How can West Brom segregate multiple property owners from those with just one BTL property?

The credit team from West Brom called me today regarding the increase (following on from me calling customer services) - I was told I would receive a questionnaire to fill in to decide if I would have to pay the increase. I don't really know if this is relevant or not. Has anybody else been told this or received the questionnaire?

We have had our complaint letter confirmed in writing by them with details of how to contact the Financial Ombudsman once they have looked into it - no sign of a questionnaire here. Will be interested to see one!
