West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

Tracker Rate Class Actions Updates

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

Referring to my earlier post, can someone who has been affected by WBBS complain to "Which". It would be good to get an opinion from the consumer champions. They defo did not agree with BoI.
Am not personally affected but have registered re class action.

I don't know if this has any relevance with how west brom found out their information regarding number of mortgages held, but I am a subscriber to equifax. On the 8th August west brom deleted my two accounts from equifax , then added two new ones on the same day.
Moving forward to the 31st of August they deleted the accounts again. Now they not showing on my credit file at all. Very strange.

West Brom Building Society are relying on most landlords being narrow minded and only worried if their action affects them directly. I think we need to stop talking about class action, step up and actually start it. Mark as the owner of Property 118 you need to tell us what you need to take action as the other landlord associations and bodies reporting to help landlords do not seem interested in helping landlords like us despite having earned a lot of money out of us all over the last few years.
Just tell us what you need and when you win which I am confident you will you will be the leading body ' promoting and protecting the interests of landlords'

Well done on the 625 sign ups so far. Whilst it is optimal to have 1000 people to give the case a lot of weight..... is it imperative? There may be some of the sign ups who are willing to add some more to the pot to get it over the £100k if we are struggling?

Mark, as the issue is clearly getting this action out into the widest possible community, can I suggest that a good way to net in interested individuals would be to publicise it through the property pages of major local newspapers. For example, the Oxford Times has a very large property section which always carries items of property related journalism, and I'm sure the same is true all over the country.
If you were to prepare a press release for sending to these papers, I think you could get a lot a very targeted publicity - the journalists are usually desperate for interesting copy, and local property investors are very likely to be reading these pages on a regular basis, so you will raise awareness very quickly.

Do we have any decent PR people reading this who could put together a Press Release?

Ideally, all those who have signed up will contact their local newspaper. I suspect the media will be more interested if they can report on a local person who is affected.

Perhaps a phone call to the editor would be better received in this regard?

Hi. We also had the letter from West Brom for one property. When we phoned we got the script response. When asked how they knew we had other mortgages the person had to ask someone then come back with another script saying that referencing agency’s let them know. We are now asking to know which agency’s ‘gave’ the information. Is this a bit illegal – taking out a credit check on us without our consent – and was this a hard check that leaves a footprint on our rating?
Of course we are happy to join your class action and contribute the £100
