West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

Tracker Rate Class Actions Updates

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

Spot on TSFI. Apart from the increase in monthly interest payments which are onerous enough I'm sure we have all suffered knock on effects of both financial and other kinds. You have spelt out yours eloquently and so might make a claim against WB for a specific amount of money. And why not?

Maybe the time to do this would be after we have won in court though as the action won't cover this sort of thing? Also the way to do it might be through the Small Claims system?

For me financially a knock on effect most definitely is that with my WB property a redecoration and other improvements were in the pipeline last September. The WB bombshell means the £3000 pa odd extra I am now paying them has effectively gobbled up the money I had "prudently" earmarked for the work. So I must cancel/postpone or find the money elsewhere which I cannot as I don't have it.

Perhaps I'll join you in the Small Claims court?

Sorry to be a killjoy but any representative action will be for restitution in terms of overpayments, associated legal costs and sticking to our interpretation of the contract ONLY.

Any other claims, such as those which have been posted today, will have to be dealt with separately and privately.

Mark, I don't believe there is any misunderstanding about your "killjoy" remark. But it is nice to think that later perhaps, armed with a win in court, that those of so inclined might seek restitution for our knock on losses. As Horace Batchelor said many years ago about football pools "If you are not in you can't win".

If we win it has to be worth a punt in the Small Claims Court at the very least.

I'm sure I will easily be able to demonstrate just under £10k of lost earnings related to dealing with this 😉

Mark, my post this morning seems to have stirred several mixed comments on this forum which I imagine is exactly what is required to spark interesting debates regardless of ones opinion. Lets have our day in court and win, I know that is what you have been pushing for all along with your posts and encouragement for many doubters on this site.
Personally a win in court for the group against WB would be fantastic, for me it would generate personal litigation against WB for consequential losses incurred.
