West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

Tracker Rate Class Actions Updates

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

Just had a letter from WB:

"I understand that you have requested that we reconsider our decision, as you believe that your circumstances do not meet the criteria we have set, which is that you are linked to 3 or more BTL properties.

For clarification, the application of the criteria is based on your current portfolio and not your circumstances when you originally applied for the lending."

Hopefully that answers the question from a couple of weeks ago.

I'm not sure which is worse:
the attempt to mutate a "Lifetime Tracker" into what is, effectively, a Variable Rate,
or
the absurd criteria of 3+ current BTL (way after the original application).

It may be WB haven't heard the idiom that "Two wrongs don't make a right".

Your mortgage with West Brom is a variable rate, all tracker mortgages are variable rates.

What your mortgage is NOT is a standard variable rate

A standard variable rate can be adjusted by a lender at a whim, much like West Brom are doing to us. However, a variable rate which is a tracker cannot be varied at the whim of a lender, as we are on the verging of proving in a Court of Law.

SECURE FORUM

All valid applications to join the Secure Forum have now been approved.

Confirmation emails have been sent but it would appear they are getting stuck in spam folders or being deleted by internet service providers because the security we have on the website is so tight the internet service providers can't validate that we are not a spam organisation!

Anyhow, all is not lost. The link that was sent to you by The Law Department to join the secure forum can now be used to access the forum. All you will need to do when you link through to the forum is add your user name and password in, which you supplied when you registered, and then you're off 🙂

For those of you who have NOT logged in yet, be warned, there's a lot of reading. All good stuff though and I feel we are now getting a very good consensus of opinions based on the numerous decision we need to make.

This is also not correct as the criteria is not based on current portfolio's ( I now only have 2 BTL's ) they have told me that it's based on your portfolio as it was in September 2013.

Terry that is what they told me that it is based on your property portfolio as at September 2013 when they increased our tracker rate mortgage and I have this in writing from them.

It looks like they are not applying via the backbench business committee. Transcripts of the meetings on the bottom of this page http://www.parliament.uk/business/committees/committees-a-z/commons-select/backbench-business-committee/
