West Bromwich Building Society Tracker Margins Legal Action

Are you affected by the West Brom Tracker Rate Hike?

If your mortgage account number begins with the number 8 you are highly likely to be one of the unlucky 41% of the mortgage customers of the West Bromwich building Society with a West Bromwich Mortgage Company account affected by the 1.9% increase in your tracker margin rate. However, if you arranged your mortgage directly with West Bromwich Building Society (i.e. not via a broker) or before 2006 the chances are that your account number will begin with the number 9 and you are not affected – YET!!! West Brom will give no assurances that mortgages with account numbers beginning with the number 9 will not be affected at some point in the future.

OUR INTENDED CLASS ACTION LITIGATION OVERVIEW

Tracker Rate Class Actions Updates

The reasons we started this campaign are very simple:-

1) We believe the actions of West Brom are immoral

2) We believe the actions of West Brom are unlawful, i.e. they have no legal grounds to increase their tracker rate margins

3) We have no wish to subsidise other areas of the West Bromwich Building Society business model

4) We are fearful of other lenders following suit if West Brom are allowed to get away with this

Mark Smith (Barrister-At-Law) said …

“Representative actions, where one person starts a case representing many others, who all want the answer to a legal question from a court such as ‘is this contract enforceable against me?’ but are not seeking damages. All those who sign up to the action will get the benefit of the win, but they do not have to start their own cases, as they are ‘represented’ by the lead claimant.

The only people who will definitely benefit from success in the case are those who have signed up. There will be no free rides. Any others will have to fight their own corners individually, either alone or with legal help (which will inevitably cost significantly more than the group case).”

New flyer designed by Andy ready to be released, too late for this show though as the strategy will not be finalised until after the show which is the same date as our private members meeting. That aside, I'm quite confident of what our strategy will be but it would be totally wrong to announce it until all members have agreed it.

Oh blimey - thanks Richard - I've clearly had that one wrong for ever 🙁 how embarrassing - especially as I'm a teacher and worse even than that as I'm always quietly and internally giggling at other people's mistakes (pacific instead of specific, your instead of you're, their instead of there, hour instead of our to name but a few ... and the best ever discussed instead of disgust!)
I will NOT be making that mistake again LOL

Brilliant flyer, says everything (nearly) very persuasive. Would have been nice if you could have found it in your hearts to just somewhere mention that others are affected that 118 also supports BOI. It wouldn't have distracted from your campaign. It could have been possible that a person who has no WBBS mortgages but does have BOI mortgages may have picked up on it. It would have done your cause no harm, we are not in competition. I think that the WBBS case is helped in the press especially the popular press by the fact that the BOI is not just landlords but also homeowners and because of this the press/radio feel better about running with the story. Nearly everywhere you see the two cases lumped together. I have spent 2 whole days doing nothing but collating material and looking up contacts to get some press coverage and it never occurred to me not to mention WBBS and BOI equally. I wish you all the very best of luck though, sincerely. (You probably guessed I only have BOI mortgage, but have followed your forum every day and really feel one of you, I will truly feel thrilled when you succeed.)

I agree and the last flyer did exactly that. This one was a bit of a rush job, we only thought of it this morning. Sadly, by the time Andy sent the first draft to me I was rishing to get out on an appointment so I didn't pick this up. By the time I got the final draft I had already gone out and now that I'm back Andy is heading off to his holiday home.

Please bear in mind that Andy isn't getting paid for this. He's just a regular member affected by the West Brom rate rise and volunteered to help out of the goodness of his heart to benefit this campaign.

I think he's away for just a long weekend though so we may be able to get a version three done in time for the Landlords and Lettings Show next Wednesday and Thursday 🙂

I am going to ask Andy to take another look at the hyphenation in that section though.

Hi Mark, I do understand these things don't worry. I did like you see the BOI mentioned in the EDM part at the last minute and I nearly cancelled my remark as I really don't want to make contentious remarks.. But it in no way links it with 118 and the rest of text, some people may have the wit to google 118 for BOI but it is unlikely. Hopefully our day will come.
