Hello, North Norfolk district council is charging me one day’s council tax because the tenant moved out at 11am on the 9 /8/23. The new tenant moved in on the 10/8/23.

As the tenant didn’t sleep at the house on the 9/9/23, I’ve got to pay one day’s council tax – this don’t seem right.

I’ve told the council they will get no more info from me in the future – and he said ‘more work for the girls in the office’.

Thoughts?

It isn't right, the Council is incorrect and I have this error corrected on at least two occasions, I can't remember the case law.

Tenant as per contract is responsible for utilities until the day he moves out
The council sees moving out on the 9th as the 8th.
So putting 00.01 on the 10th as leaving would have aleviated all of this and the Council would have been happy chappies Nobody pays part days council tax

The cost to your local council to send you an invoice will be about £30
plus additional time to chase up payment all to recover £3.
Write to your local councillor and pay up soonest!

I received a call from my council telling me I owed 11 days council tax between tenants but the first tenant moved out 8 days earlier than his tenancy agreement stated which made him liable for the tax however I said that I don't mind paying for the other 3 days to which the lovely lady said "oh in that case I'll send the tenant another letter but there's no need for you to pay" . I said I really don't mind paying but she absolutely refused. I'm still waiting for ' nasty threatening letter' from them but 18 months on I've heard nothing. Strange times

As everyone else has said you do have to pay. But not if it is unfurnished and empty.
My local council don't charge on this basis for a se
t amount of time.
Also a 25% reduction if unfurnished and uninhabited.

My council do the same. Unless it's a same day move, the landlord has to pay council tax on the day the tenants left, up to and including the day before the new tenants move in.

Had this argument with Council about day of leaving.
Tenant responsible for utilities until day of leaving
You have to say Tenant left Midnight on the 10th at 00.01, as saying 9th means they left on the 8th
As you say it is unoccupied and unfurnished
There is no part day charge for Council Tax

You should have moved in for the night and benefitted from the single occupancy rate. Better still, move your student child in for the night and there’s no council tax to pay

total crap. Tell them the time of the day the tenants hands the key back is irrelevant as the notice period ran until 11.59 the day they moved out so they are liable for the last day of council tax.

I regularly have to remind the idiots at the council this!

It's not the notice period, it's a matter of who holds the keys. Can you really expcet the council to belive you were there ar midnight? They base their theory on the fact that agents close about 5-6pm. and the keys would have had to have been handed in by then. As I said in a previous post they don't usually bother anyway sending you a bill. I've only paid a couple of times in all my forty years. Landlords have much greater things to bother about.
