Should I report another landlord who refuses to get a CP12 certificate and if so, to whom? CP12 gas safety certificate

1 By not doing it he is breaking the law AND the press will have a heyday screaming about him and rogue landlords in general.
2 By giving himself a pecuniary advantage law abiding landlords will have less profit to re-invest.
3 His insurances, if he has any will be invalidated.

i doubt his insurance would be invalid. never seen a policy term specifically referring to CP12's (i used to be a loss adjuster).

hi mark,
this is more of an insurance broking issue than a claims issue. it really just depends on how the proposal question is worded as to whether you need to disclose BTL claims. ive had four BTL insurance claims and that has never been an issue with my house insurance. as ever shop around till get the right proposal question and quote.

The reason Landlords have to provide Gas Safety certificates arises from the duty of care the landlord owes to the tenant.

An owner occupier cannot owe a duty to himself in that if he fails to protect himself from loss then the failure is not actionable.

It's common sense that all properties with Gas appliances should have regular checks but the law still allows us to take on a certain amount of personal risk. Otherwise smoking, mountain climbing and motor racing would be banned.

The law makers and judiciary have always been reluctant to enforce safety duties on the private citizen. On the other hand they are increasingly intrusive where one party owes a duty to another as in the renting agreement.

Several landlords have done jail time for this and it will continue this way.

Yesterday Nick Raynsford brought a motion in Parliament to enforce mandatory smoke alarms in PRS properties, it passed 245 to 8. So you can expect a duty to provide and maintain smoke alarms soon.

Whether you agree or disagree with proposals like this there is a direction of travel in regulating the PRS. Personally I don't think that this will damage the sector. The average good landlord will do what he needs to and the bad landlord will ignore it, just like before.

Our rental properties are flats so our residential neighbours, who do not get their gas appliances checked, are equally likely to put my tenants at risk than the appliances in my property. I recall reading recently that a carbon monoxide alarm was going off in a rented flat but when the authorities arrived to check this out they found no issues within the flat. They went to the flat downstairs and woke the occupants (owner occupiers) and found it was their boiler that had the co2 leak which was leaking into neighbouring flats through the communal stack and vents between the flats - thank goodness one of those flats was rented and had the alarm!

Yvette, you are absolutely correct. However, so is John Daley. Maybe legislation requiring annual gas safety checks in, at least, all multi occupancy properties, would be a good idea.

I am well aware that he is breaking the law. I only have one property which has gas supply. The amount of grief I get from the tenants to allow access for the annual test to be carried out. In fact if there is change over of tenancy within the year & get a new test done.

The media will have their flavor of the month. As we all know that 95% of the Landlord's are decent people & ensure that they comply with the law no matter how absurd the law is. We cannot be going out of our way to compensate for the practices of the 5%.

I had personally suffered from carbon monoxide as my late brother died because of it.

This does not however change my view of others becoming do gooders. There are bodies/authorities who are responsible for such issues.
