Jumping through hoops – Repeal of Section21?

The repeal of Section 21 is a game-changer and I`d like to know how other landlords are planning to deal with it. I`m not talking about the reasons for evicting a tenant which are in the current Section 8, but situations such as retirement, a wish to leave the problems behind, realising the equity etc – basically where a landlord WISHES (why can`t we just do as we want with OUR property? Oh for the old days) to sell and it has nothing to do with the tenant.

I know that selling up MAY be a recognised reason for eviction, but in my mind, it is a doubtful one that will almost certainly require us jumping through many hoops, and even then will depend on which side of the bed the judge got out of that day or what he had for breakfast.

Some of my properties have tenants who are decent people and would very likely leave if I wanted vacant possession, without being awkward or going to court. But there`s always one, or a girlfriend who says “But you don`t need to move darling,” or one who has no money and wants to be paid to leave.

So two answers are decent tenants and paying – but how much?

Paying to access our own equity…..sounds crazy, doesn`t it?

Any other ideas?

Sec.21 is NOT "No Fault" it is "no reason specified". No fault is being being used by Shelter, Generation Rent, ACORN, et al as a stick to beat up Landlords making the tenants look like innocent victims of those nasty Landlords.

The reality is most of the time it is tenant misbehaviour that is the unlying reason and using Sec.21 is the most efficient route to eviction as other routes are not fit for purpose.

I think I've done 9 evictions over the 25 years, ALL for damaging house or rent arrears. ALL used Section 21.
Why would Landlord spend 35k deposit on a house.
25k refurb.
Then evict tenant for no reason.
Landlords NEEDS that rent in.
If he/she using Section 21, something gone wrong along the way.
We know it ain't cheap & it's last resort.

Ooh by the way me evictions have come by way of Govt introducing Benefit Cap putting tenant in arrears. Or Council bringing in Selective Licensing where Council (we thought) was gonna inspect house where tenant kept damaging. And we have to repair tenants damage & tenant damages again.

You will find that it is also described as "no fault" in the official court documentation and whenever S21 is referred to by Government. The argument has been lost, such is the influence of Shelter et al.

I will be exiting BTL this year, and have one remaining property. The tenant has been excellent and I don't want to evict her, but unless I can sell to a buyer who is happy to accept this good tenant, or she will be willing to vacate, I will have to evict her using S21. I will try to help her find accommodation within the same development, but do not see why I should pay her to leave.

When there is enough supply for him/her to find something else its less of an issue. When there is a total supply issue/inflated rent situation, then in some cases many will stay as long as they can as they literally have no where else to go.

Even the best LL in the world who wants to help in this situation cant as there is no property out there.

I have been playing musical chairs with my tenants. In order to keep a good one that needs to downsize, I am trying to evict a bad one to free up this property for her. I have tried finding somewhere else in the private sector myself for her and its impossible. Smaller properties MAY be available but at higher cost than she is paying now so no point moving at all. Apart from downsizing space she's being sensible and moving to reduce her outgoing expenses.

The bad tenant clearly no where to go so she's going to hang on as long as possible causing more wasted time and cost to me to get her out.

Bloody nightmare and that's when you are trying to help!

It's only lost when we throw in the towel, like the NRLA have done.
Pleased to see iHowz are still fighting our corner, and continuing lobbying Government not to abolish Sec.21. Pity the NRLA don't have the guts to continue the fight.

Has iHowz considered changing back to calling themselves the SLA?

It has more gravitas and their views are a lot more representative of landlords than those wheeled out who claim to be the mouthpiece of ordinary landlords.

(I was an SLA member but thought iHowz was an online letting agent!)

I've seen them (Must be Rod) on here before with good links info.
