Had to pay solicitor to prove I don’t own the Council’s land!

You couldn’t make this up. The neighbour to one of my houses I’ve owned 22 years asked Nottingham Council to maintain their trees close to his house. Nottingham Council said Not our trees, they’re that Landlord Mr Roberts. I of course said Not mine, they’re the Council’s.

Nottm Council went to Notts Council, and they couldn’t decide amongst themselves and their army of Legal experts and solicitors who owned it-Obviously can’t read Legal documents, so the Council wrote back to the Neighbour and said Not ours, and to take Legal action against me.
And they can’t come out to look because they are on Mick Roberts land.

I had to contact my solicitor, pay their not cheap fees as you know, and my solicitor found the answer in 30 minutes.

Now here’s the biggie, after me now proving I don’t own and the Council do, the Council now WON’T pay my solicitors fees. Even though I have emails from them acknowledging their mistake, they’re now refusing to pay and say I’m to contact their insurers.

These are the same people that operate Licensing that tell us how to rent houses out. And what the tenants can and can’t do.

Nottingham Council seems toxic through and through. From top to bottom. NEVER listen to us on the ground. I’ve housed that many of Nottingham Council homeless over the years and NOT ONCE has the Council come to ask me how me and the tenants I’ve helped them out with, how we’d be affected.

If they’d have rung me on the first instance on this tree case, voilà. But Oh no, no communication from the Council & they are driving me insane.

Update 22 June 2021
I’d put in an official complaint for Council to pay my legal fees due to their inadequacies, they’ve obviously not read the letter properly, passed it to Tree services who have replied-Not our land.

Gees, these people!

What an excellent opportunity to have ignored the tree and I would have said yes that land is mine, as I had been on it for so many years and no one has claimed it, that tree is also mine, I planted it, since the council has admitted its not theirs and it belongs to a name they mentioned, I wish i was that person, free land! You should have grabbed this land, missed opportunity! and sold it to developers.

Told 'em that Neil. I get it very often on Neighbours fences & Council say Landlord needs to prove it's ours even though they have far more resources than me. And often I've got the deeds to show em the T mark inside the boundary.

However these Trees lark, cause it was so far away from my house, I couldn't read the Deeds, that's how obvious it should have been to the Council.
So u know exactly then Neil how thick this Council lot must be.

I am hopefully gonna' take it to your link the Ombudsman, as I'm not gonna' accept the fee refund even if they offer as we have this problem also, which I've had before. U can't reply to their complaints & only start another new one, therefore the original complaint never gets resolved:
I get I think XXX, had him before.
I ask How do we reply to u when u send us something that is completely wrong?
He says if I’m unhappy with response, we supposed to email another email.
That is complaintreview@nottinghamcity.gov.uk
Can I ask why that email is not included in the email?
He says What do u mean, if u not happy with the response.
I say Yes of course (& we generally aren’t happy with the Council response) as it’s always wrong.
He says not sure, be an error on his part to not include the email address. Email address is NEVER included.
Cause our only solution is to start again & get new reference number & Council log it as new complaint.
I tell him he’s wrongly forwarded my complaint to trees & why has he done that?
He asks where my complaint should be sent to? I don’t know, that’s why I send it to them, they should know this thing being in complaints.

Yes, I'm talking to Chris PossessionFriend who may do me small claims court, although he's said as others have too, I'm unlikely to get my costs, as my time is £200 an hour. But I'd like to do that as well as Ombudsman. Nottingham Post (local paper) are doing story on it as we speak so Council may pay up now the original solicitors costs, but I now want my time paying for, so hopefully I can do the LGO route too. But as many know, Ombudsman useless at moment cause they snowed under.

John, I'm a busy boy. My time is worth more than £3. I have hundreds of 5 minute jobs to do like that one. For me, it's simpler to let the solicitor deal with it. And I may have not understood the deeds anyway.
And I need to get away, I'd rather spend time trying to get me head round the testing procedure which to me seems like u need a Physics degree, than spend any more time than necessary on the Imbecile Council procedures.
Yes I agree, & I hope they do refuse costs as I'll get more satisfaction with them having a Government Ombudsman decision against them.

Ha ha Yes Barry, that is what has been said, I'll take it then, can build a driveway through it to back garden & I now have house in centre of Bulwell with own driveway-Quite rare.

Such a shame you couldn't take adverse possession of the land, deal with the tree and if the council ever got off it's bottom and claimed the land back, their correspondence stating it wasn't theirs would damn them in the courts.

Yes I did think that. They would blame it on office junior. I've now found out he's a Councillors assistant. He was so nice to talk to, I din't want it to go this far.
