It has nothing whatsoever to do with money!

Due to having no mortgage on this property, Mark wasn’t at all affected by the Section 24 restrictions on finance cost relief or rising interest rates.

As many Property118 Members will be aware, Mark Alexander emigrated to Malta back in 2016. What you may not know though is that he added his former home to his rental property business when he moved out of it, but has now decided to sell the “jewel in the crown”. The important question is WHY?

Mark explained that despite obtaining glowing references before a tenancy was ever granted, the people he agreed to rent his former home to turned out to be social misfits and had no respect for his property or their neighbours. He said “their incomes were good and they even continued to pay rent despite the pressure (or lack of it) being applied by the Court system. I counted my blessings that at least they were still paying rent at the time, but little did I know what the future held.”

Regardless of his very best efforts, Mark spent nearly two years getting his tenants out of his property after it finally came out what had been going on.

It transpired that Mark’s tenants had mental illnesses, something no level of referencing is ever likely to reveal. Sadly, this resulted in his tenants showing no respect for his property or those living around them.

“The justice system is broken and landlords don’t get any help from anywhere”

After months of waiting, finally, a date for a Court hearing to obtain a possession order was issued. However, that date was 13th March 2020. It’s a date that Mark is likely to remember for a very long time because that was the day the Courts were closed down in response to Covid. He was told that the hearing had been adjourned, but a few months after that an eviction ban was enacted.

When the Courts eventually re-opened they had huge backlogs. Possession cases were given the lowest possible priority. Finally, after months of chasing for a new Court date, the Courts insisted Mark re-started the possession process again from scratch. That meant waiting even longer than he had before because the minimum notice period at that time had been extended to six months. It seemed nobody could help, so eventually, Mark very reluctantly entered into a private financial settlement to finally move his tenants on. He needed to put an end to the ordeal and throwing money at it seemed to be the only available option.

It cost Mark over £200,000 to get the property back to its former glory and ready for sale, but the reason he’s now selling it has nothing to do with the money. He says “I simply cannot risk putting myself or my former neighbours through an ordeal like that again.”

The property has since been fully refurbished, a project that started in April 2022 and was completed just a few weeks ago. The property is currently occupied by Mark’s relatives for security and insurance purposes, however, it will be sold with vacant possession.

Mark has asked all Property118 Members to share this article on Social Media to help renters begin to understand why it is becoming increasingly difficult to find a decent rental property. It has very little to do with landlords being greedy (as mainstream media would have them believe) and everything to do with naive Government legislation coupled with a broken judicial system.

The reported mass sell-up by private landlords is set to increase further when the Renters Reform Bill makes things even harder for them, says Mark. Higher interest rates combined with an unfair tax system for private landlords are also causing many private landlords a double financial whammy.

The system is truly broken.
I have gone along the accelerated section 21 option.
Got possession order only to have it set aside because tenant has submitted letter stating she has found faults in property,has vulnerability issues,used rent to buy food,and council who drafted letter had no where to house her.
Baffled because no where has she challenged the paperwork or procedure which is all correct.
I have not along possession and rent arrears but straight for possession.
Shows how courts and councils are fighting landlords to cover up broken housing sector.

Great article & description what is going off in the real world.

The Court system is disgusting. I've got a possession going off now where the tenant has agreed to go, wants to go, has even signed the below letter & we at 9 months now & every process of the court system is mean't to wear u down-Some words from me above that too.

Great house by the way. Similar to mine in individual ways. My offices are scruffier.

N235 enclosed please if you can not use the one you sent me back. Can someone please now ring me to confirm all is ok, so we don’t miss another deadline.
You have also gave us only until 15 Dec 2022 to reply & thank you for allowing this by email. Can I ask why you didn’t email us too, to not delay things? Considering the Royal Mail strikes too? The cheque was cashed on the 24th Nov 2022.
I’d just like to see this process much better as tenants can’t get houses as it is, & the harder & more awkward this process is, the worst it then becomes for tenants to get somewhere next time as more Landlords sell & be super selective.

Why in 2022 can we not do this online or by email & pay electronically?
All this extra work, Landlords report on the forums, remember & tell people how hard it is, Landlords pack up &/or only chooses the most perfect tenant next time, makes it even worse for tenants.

Why doesn’t the court automatically start the process once the 14 days has passed for the defendant to file a defence? As the Landlord would never know. This leaves the Landlord to do even more paperwork when he’s already asked the court to deal with it. I’d have thought better for tenants long term if the Court just started the order/hearing once that date has passed, landlord is less frustrated, & is more like to take a chance with vulnerable people next time. As it is, the harder this process is, more Landlords pack up & don’t house the low earners & benefit tenants next time. I know this as I’m biggest benefit Landlord in Nottingham & I wish to sell all my houses, but I can’t as my tenants can’t get anywhere any more. I’m stuck with them for life as I cannot ask good tenants to leave, even though they paying 70% of market rents. I also can’t carry on forever being 70 years old & getting Govt throw me in prison cause they want an EPC C which may cost £900pm rent when the tenant is happy to pay £500pm for EPC D.

More Government & Council intervention, retrospective legislation increasing rents & making the good Landlords pack up & sell leaving low earning tenants unable to secure accommodation nor pay extortionate rents.

Dear Court,

I will not be contesting this eviction at all.
I get on with my Landlord. My partner and his joint tenant son left leaving me unable to pay the rent.

DWP Universal Credit UC constantly messed my claim up and payments to my Landlord making the situation worse. Please pass this on as part of the reason for eviction. We can't get houses any more because of UC. Something needs doing.

My Landlord wishes to sell all his houses anyway due to UC and Nottingham Council Selective Licensing, and my two points above has bought forward his selling decision on this house.

My Landlord has to go through all this expense and hassle, as the Council Housing services for me, won't act until bailiff date as you may be aware. So if you can please hurry this up, as the delay is not fair on me nor my Landlord.

I’m so sorry to hear of this episode Mark. We have had the same experience but with the added involvement of Lincoln City Council fighting for two years to keep the tenants in our house (which the tenants have wrecked and also have anti social complaints about them). It has cost us £25,000+ to get them out and the Council have fought us all the way. They abuse the broken judicial system fully. Finally got them out two weeks ago and now sorting out the terrible damage.

This reinforces my belief that to secure good tenants you get references off their penultimate landlord and visit them in their current home. If they refuse these terms simply don't accept them.

Heartfelt article Mark , you are a winner in life. I follow the videos etc. and mightily impressed with the great attitudes. What a nightmare for you, Like yourself, the vast majority of landlords are compassionate capitalists, taking to the cleaners by .Gov, playing God to tenants nature, an impossible task, except for looking back lol Inspite of the challenges, we somehow still have a naive belief in our fellow human beings,......so please keep on keeping on , personally ive been worn out by it all lol one bombardment after another, but will see it through unless I decide I have a firm grip on an empty sack in a years time xxx

Hi Mark, I trust you, and any other landlords doing similar as you are now at least feeling better for taking positive action to protect yourself from the potential of future hits like this, that No-one but landlords seem to understand just how devastating the effects are upon landlords or their wish to continue to offer homes to tenants.

since the eviction ban came in I have personally stop letting to new tenants.
Now i just plan to sell when any tenants leave, my sight is still set on properties investments but with No Tenant Factors.

No Landlords equals No Homes for Tenants. What will to Boohoos say then?

I'd be interested to know why you decided to do a full refurb at £200K from abroad rather than just sell it as is. Was it tax reasons ? Thanks.

No, nothing to do with tax.

This is the type of property that is quite niche. The type of person who will buy it is highly unlikely to want to do the refurb themselves.

Also, it was left in a terrible state. Words cannot describe the covert vandalism alone, which wasn’t immediately noticeable. For example, a PCB was cut in half in the hot tub. Holes were punched in toilet systems to cause flooding. Plates of food and dog shit were hidden under beds. The list goes on and it hurts to even think about it as I type, so I will leave the rest to your imagination if I may?

That's exactly how I work too, but it didn't save me on this occasion.

My tenants were divorcees who had got together. Previously they owned their own homes, so no previous tenancies. Both homes were well kept, no mortgage arrears and strong financials.they are no longer living together and have since become homeowners again.
