My own landlord’s GDPR policy

GDPR is something that WILL affect almost every landlord in the UK. The new legislation comes into effect on 25th May 2018, by which time all landlords (and other businesses) will have to have registered with the ICO and have a GDPR Data Protection Policy.

We have spent the past couple of months preparing for the implementation of GDPR, and have now finalised our GDPR Data Protection Policy, (which is worded specifically for a residential landlord business).

If any Property118 readers would like a copy of our GDPR Data Protection Policy, to perhaps adapt and adopt for their own landlording business, we are willing to email this to them FREE of charge.

Even if your properties are fully managed by a letting agent, you are still likely to have personal data about the tenant (e.g. names, contact details, date of birth, knowledge of household composition, knowing whether they are employed or on benefits, etc) so that makes you a "data controller", and as such you should be registered with the ICO and you will have to comply with GDPR.

Someone has asked me if my GDPR Data Protection Policy has been signed off by a solicitor. I would like to make it crystal clear that I am not a solicitor, and the policy has not been signed off by a solicitor. However, I do have experience of writing policies and procedures.

As this is new legislation, and has not been put to the test in any court, there is no caselaw or judicial decisions/interpretation, so I doubt that any solicitor would be able to "sign it off" as either correct or incorrect. However, if any solicitor reading this would like a copy to check over and report back on, just ask.

A lot of time and effort has been put into the development of what I believe are suitably worded GDPR documents, as you will see when you read the policy, and this has taken many days of solid policy writing, by two people (myself and a colleague), over the course of the last few months.
