I have issued a S21 to a tenant. I need to sell the house (they have never been a great tenant!). The council and Shelter have apparently advised the tenant to stay put – a familiar story I believe?

The tenant says the council has said some social housing is being built and she will get one, but even if true there is no timescale.

I have checked and double-checked and the S21 notice is valid – safety certs, deposit, prescribed info etc are all compliant. So my question is, can I go it alone or is it sensible to ask a company, or a solicitor to handle it?

I haven’t done this before. I don’t mind paying out to ensure it goes through, but who do I use?

I’ve only heard of Landlord Action.

I recently used Legal for Landlords to evict a tenant under Section 8. I would advise paying a specialist for a smooth service. If you make one little mistake you will have to start again. It really helps to take the stress out of the situation.

My feckless tenant refused to pay for 14 months. Paid one month's rent in the month of the first court hearing, believing that would re-start the clock! He was self-employed, continued working throughout lockdown, received all the SEISS hand-outs, had a tax rebate, and claimed not be on benefits. He held noisy drug and alcohol-fuelled parties during lockdown and the Police did nothing [too busy with Boris!]. Since eviction, I found out he was claiming LHA and saw a letter saying it must be paid to the landlord. He was advised to remain in the flat, but I've no doubt he painted a different picture to his 'advisors'! I've had it with BTL and am selling up!

Annie, Unless the arrears were the only reason you wanted to sell then it's not relevant that they've paid now. In case it's crossed your mind, it would be very rare for tenants to build significant arrears and then be reliable payers in future. Given the picture you've described I wouldn't back out.

Yes I’ve recently used Julian Meek at Landlord Group for a Section 8 and possession order obtain earlier this month. Very professional and impressive service. Also standard set of fees so you know exactly what you’re paying. They’re the other firm (senior partner Chris Squire) that are featured along with Landlord Action on Channel 5 Nightmare Tenants show.

I have sold all but two, as I'm one of the many landlords leaving the market. Been doing this for 15 years and don't want to do it any more! The arrears weren't significant but payments have been erratic for years. I'm retired and just don't need the stress any more

I am in the same position. Why put up with BTL hassle and vilification, when we should be enjoying the fruits of our labours in retirement?

I now only accept people with a university email address: it means they are coming to Cambridge to research and then going back to their homes. I used to house the less well off and was profoundly kind to them: I had queues of potential tenants. Then one professional scumbag conned his way in and nearly sent me to the loony bin! He had all the help from the council. He played them and they knew it but I was always going to be the villain because I was a landlord. Bad!!!!
Eventually I sold up to an evil landlord and said tenant fled and must have done a two minute mile!!! Result: one good landlord less and one bad landlord (with muscle) gets bigger. Thanks council! Brilliant job I don’t think! So, screw btl. If they want to drive out decent landlords because they are inept so be it. Eventually there will be a major crisis and the b&bs will be heaving - at serious cost to the councils. Hoist by their own crass jobsworth stupidity!!!!
