Marijuana in the post!

I have 3 flats, one with a bad Tenant awaiting eviction, S8 issued. I have intercepted a quantity of marijuana in the post, no name on the package, but I know it’s for this Tenant.
Am I under an obligation to report this to the Police?

Hi Peter,
We have lots of readers stories about Marijuana, but it is usually growing it at the property.
I am guessing as you have now taken possession you should report it so you don’t get embroiled in an illegal activity, but as the package had no name on it I am not sure if it proves anything.

Dont bother, the police arent interested unless there is photographic evidence of the selling of a class drugs

I agree the police do not have the time or resources to investigate drug abuse, they are too busy pursuing technical traffic infringements.

I would just return it to sender if there is one written on the envelope. Otherwise, simply pour it down the drain or something to destroy it. You’ll save yourself a lot of aggro that way.
As Jamie Moodie rightly said, there is no proof the your tenant is responsible for this. Without solid incriminating evidence, the police won’t do much about it. And even if there is evidence linking him to it, the police are unlikely to do much unless it is of sufficient quantity to suggest “dealing and with intent to supply”.

Peter, you should report this to the Police and hand over what you have found. Taken in isolation there may well be insufficient evidence but the police may well have existing evidence or knowledge of what is going on. Unlike others on this forum I would not expect the police to be in a position to take action without evidence. How will they obtain this evidence if you do not provide them with it! At the very least you have a moral duty to report the matter.

Hi all and thanks for all the advice. I have flushed it down the toilet but advised the Tenant that I will hand it over as evidence if she doesn’t get out and leave the property by the end of the month. She is on a Section 8 notice and I want to keep up the pressure. Bad Tenants really are depressing!!

Hi Peter, at present “you” are in possession of illegal drugs. If I were you I would dispose of it asap. Your former tenant may at this time be stitching you up by reporting you to the Police! Even if you took it to the Police, with all innocence, they could still charge you for possession, at the very least you will undergo vigorous cross examination.

don’t tell the Police anything as if they are imprisoned for what else they have in their flat (what you’ve seen is only the tip of the iceburg) then you will have hells own chance of evicting them

It’s only illegal if you open mail ‘without reasonable excuse’ or if you ‘intend to act to another’s detriment’
so the drugs would get her into trouble and you could also be prosecuted
also if you say anything to her would she not have a good counterclaim
it makes you an accessory
