HCEO’s What has been your experience?

Last year I obtained a CCJ against a guarantor which I subsequently upgraded for enforcement by HCEO’s (High Court Enforcement Officers). I expected fairly swift and effective results but to date no payments have been received. HCEO's What has been your experience

The HCEO costs are now about double the original debt!!

I am VERY disappointed with the service I have received which is far different to that shown on the TV programs.

Have you had a similar experience ?

Is there a different, perhaps more effective, way to go about trying to get monies due from a debtor?

Alas, this is often the case. And again, it's a commercial decision. Whilst difficult to enforce we have had some successes in such circumstances, usually where friends or family assist.

Where the debt is greater than £750 you are well within your rights to have a statutory demand served and then petition for bankruptcy if the debt is not settled within 21 days.

This will cost you money, especially if a defence is filed, so you have to consider the cost of vengeance. It is unlikely to be commercially viable but I do understand that for some people principles have a greater value than money.

Luke, unfortunately we work within a system that currently favours the debtor rather than the creditor. Enforcement powers are slowing being removed rather than strengthened.

Maybe Gove will see the light (his No2 is a former City lawyer) and give creditors the options they need to recover what they're owed.

We can but hope.

It is very rare I don't get paid, but if getting that payment was made easier, I'm all ears.

The forced sale is going to be interesting because often Judges won't allow it because the debtor needs the house to live in, but in my case the chap is (on the side) renting it out and gone back home to live with parents -Judge can't really refuse, I wouldn't have thought.

Mark, the limit for individual bankruptcy rises to £5,000 in October.

I agree with you, but we just put false hope on it , and hopping HCEO will make difference.
