Hello, I tried to evict a tenant in 2022 and got a possession order asking the tenant to leave on 1st December 2022. Got bailiffs involved but we cancelled the bailiffs as the tenants paid the majority of the debt.
Now the tenant has not finished paying the old debt, but we agreed to let them continue living at the property. They have not missed any rent payments this year but still have the outstanding, can I evict them by sending bailiffs again?

Yes you can. A Possession Order is valid for something like 6 years.
I recently got a tenant (this year) out using a Possession Order obtained in 2018.
You will need to complete a ‘request for warrant of possession of land’ form

Probably yes. But probably need to apply for a new warrant of possession.

Yes you can as, Mek stated the possession order is valid for 6 years. You will however, have to make a new bailiff application.
I did this three times for a tenant at one time

Darren raises a good point. This is far from an ideal tenant/landlord relationship. Why don’t you just meet with them and discuss the matter openly. You’ve allowed them to stay owing this debt. If they otherwise good tenants why are you not affording a chat before you charge in with flame thrower!

I wonder if a possession order will still be valid for 6 years after the renters reform bill comes in?
Landlords could seek orders before the bill comes in and then rest easy for 6 years

I wonder if you’ve just had an amazing idea???If we obtain a possession order before the bill is passed, Labour get in and bring in draconian EPC targets, then we would be able to evict to sell or evict to carry out substantial EPC upgrades??? Yes this sounds calculating but at the moment I am down to my last 2 houses and about to sell…But something like this would give me confidence to postpone their sale for a few years AND I won’t be evicting 2 families in the coming few months???
Those with much more knowledge and experience than myself…what do you think??????????

My initial thought was why let them stay? There is that old saying “When someone shows you who they are… believe them the first time”… their problems will become your problems. All these bailiff fees and extra admin time… have you added that to their bill?
