Hi All. Two days ago I got an Order for Possession through the county court giving the tenant 28 days to leave. Despite this, I have a feeling that the tenant still will not go on 18th October. So my question is, does anyone know or have any idea how long this process will take?
That is, if I start the application for an eviction warrant on 19th October when could I possibly hope to gain possession?
I have already discovered that when the bailiffs receive their instructions they will send out a letter giving the tenant 14 days’ notice before visiting the property and removing the tenant for good.
I don’t want to do the accelerated possess through the High Court unless I know that the county court possess could take months.
Has anyone had any experience of this possess and the time frames I can expect?
I live in Spain so I would like to make some plans for when it will be likely to travel back to finally get in and sort the place out.

yep. each court area has a different waiting time at the mo. so it depends on your area.
Be ready to file and pay the Warrant for Possession the day after the 28th day of your Order for Possession. The bailiffs office will then write to you n tenant, I got my letter within a week in my area of Worthing, giving a date and time the Baliffs will attend. Our area had a 3 week Baliff wait time. You indicate it is 2 weeks in your area. Likely your letter will state a date and time 2 weeks after the letter.
The Baliffs attend and kick out the tenant on that date. You organise the locksmith at your own cost.
So its 28 days for the Order of Possession. Plus a week of admin waiting when filing Warrant of Possession. Plus your own areas 2 week Baliff waiting time. So 7 weeks.
Be aware if the tenant leaves Possessions in the property you have duty of care. That takes time to sport out. Another month potentially but you have options.

Ring your local court and ask the time scale for a Bailiffs Order.
You may need it, but you may not.

I’m based in East London its taken six months so far. I’m now waiting for the county court to transfer enforcement to High court bailiffs.
Until that happens I’m …..waiting! I went the High Court route as I’m told it can take 30 weeks for county court bailiff!
The re possession legal system is a joke and The AST not worth the paper its written on.

I emailed my bailiffs office and they were very helpful with advice BUT one thing they said shocked me. they are having an amnesty in December and not carrying out any evictions!!! For me, that could mean it will be the middles of January before they will evict.

Is that because of Christmas? and not wanting to evict around that time because its socially unacceptable/ emotive in our society?
Shame our buy to let mortgages still need paying though.

How long did the high court bailiff take to evict the tenant? So what was the whole timescale from the date you asked for transfer to high court to the date the bailiff came?
