Can the council rehouse my disabled tenant?

Hi, I was granted possession after a wait of over 7 months. Since one of my tenants is disabled, the judge has given them the maximum time to stay. However, I doubt they will leave when the two-week eviction period ends.

Should I write to the council to ask them to rehouse my tenants? Even though the tenants have failed to pay their rent over 7 months, I’m feeling bad to have to evict a disabled person.

However, universal credit won’t pay me directly as they say my tenant does not qualify for full benefit due to their earnings. I feel stuck in the middle and unsure on what I should do next.

Surely the council has a duty of care to have to rehouse my tenants? Has anyone encountered a situation like this before?

    Hopefully the council can sort them out because you’re not a social worker, but alas, this can become part of the role of a LL. See if they have a support worker and liase with them but don’t be soft. Them being evicted may help them to become a priority on the housing list. And really, thats where they should be.

    So your universal credit award is made up of two things if you are renting.

    A single person over 25 gets £393/month plus there HB .
    So if there rent is £800 and the LHA is £720 , the claimant will get £393 + HB £720 = £1,113/month UC .

    If they are working and earn net £1500/month they would lose 55p of there UC for every £1 earned.
    So £1500 × 55p = £825 making there UC award £1,113 -£825 = UC £288 .

    But if they are disabled they might qualify for the work allowance which allows them to earn £496/month before the taper is applied.

    Dealing with the DWP is a pointless excersise, most employees of the DWP don’t understand how UC works and will tell you things which aren’t true .

    I have always found the best way to deal with them is face to face , unfortunately you lose half a day but it produces better results.

    Ha ha yes, they are proper thick aren’t they, the phone staff, the managers. Manager at Nottingham UC service centre detests me. Her staff constantly get wrong asking for tenancy for proof of rent. When my tenants send in 20 year old tenancy showing £80pw when todays rent is £700pm UC staff send it back saying it doesn’t show the rent tenant has put. Told ‘me 98,000 times 20 year old tenancy DOES NOT show current rent. Rent proof letter does.

    I kid u now, I had 5 UC managers come round to the table at me in Bulwell Jobb Centre about 6 years ago & say
    Really sorry Mick, we’ve only had a weeks training on this.

    More staff has asked me when I’ve been with tenant say which button is it & I’ve gone round back of desk to their computer & showed him which box to tick when extra bed rate etc. for overnight care.

    So yes u right, u better off with em but lose time going. I han’t been in about 2 years now, we shun’t have to, getting too old for this, spent about 15 years finally getting some good HB staff & contacts & emails which still have today 10 years later & now UC is like starting all over again, except as u know, we can’t talk to anyone to solve tenant being homeless.
