Starting a legal challenge to Leeds Selective Licensing?

Starting a legal challenge to Leeds Selective Licensing?

10:15 AM, 8th July 2019, 7 years ago 6

I am a Leeds landlord. The council has decided to implement this in 2 areas. We made a detailed argument trashing their points, but they have lied their way past this and used the executive meeting to pass it even though they were thrashed in one of the 2 areas in the consultation.

So we want to start a legal challenge.

Does anyone know a legal company that we can approach that has experience / knowledge of this type of case. We are a group of over 200 landlords. We have a website https://www.noselectivelicensing.co.uk/. Feel free to contact us & provide any info / advice. We will happily do the same.

We believe we can target them on the question set used in the consultation, the fact that 1 area overwhelmingly said no, the use of the IMD figures. Some areas have setup a company to fight this. I wondered if you only have 1 director who has no assets etc can be used. The money can then be donated into the company.

Many thanks

Saeed

Wish you best of luck Saeed. There have been a few Legal Challenges before would recommend you have a read up on them Brown v Hyndburn Borough Council [2018].

Larry Sweeney of the National Landlord Alliance (who’s on this forum) may be able to offer some help/advice. Also Dr Rosalind Beck (on this forum too). If you’re a member of NLA/RLA etc it might be worth having a chat with them. If you think the SL would be illegal and you’re a member of the Fed. of Small Businesses, their legal helpline might be able to give you a steer. And Google successful challenges to SL as I think a couple of proposed ones were shot down. I wish you the best of luck and do keep us updated on your progress.

Thanks for the comments. We have members of both organisations but feel they have not stood up enough to LCC. In fact NLA seemed to be in favour of it & have been very absent in terms of opposition. We have studied the cases mentioned. I’m mainly looking for details of a solicitor / barrister experienced in this field & whose costs may be reasonable. Any advice appreciated. Thanks Saeed

Perhaps you could also post on Property Tribes and Property Hub in case there is anyone on those fora who could help. Or try the Facebook pages of UK Landlords and All About Property, and I’m sure there are some others. Perhaps you could see if there are any tenant’s groups for your area and post an explanation of the repercussions to them which might stir up some interest. Have you been in touch with your local media yet?
