When condensation and mould is caused by the tenant?

Hello, We are currently dealing with a tenant who has complained to environmental health about the damp in their property. We have been instructed to re-decorate the whole property which we do not mind, but every time we go to the property, all the windows are shut, there is no central heating on, clothes are being dried, etc.

I bought a brand new 16l Dehumidifier for the tenant, when I went back to the property the dehumidifier was in the box without a fuse and fuse cover and unused.

We have told the tenant about what can cause condensation in the property and supplied him with a condensation fact sheet. A couple of months down the line we are back in the property and once again, all the above was still taking place, and considering the cold weather we have had the past couple of weeks there was no heating on as the tenant was not there.

I put his heating on in the end as the way he is living is simply damaging our property. The tenant then complained that all his heating had been used up.

I believe this tenant is in breach of contract as he is not keeping the property in a good condition, I have told the council about this. I have even recorded all the furniture right up against the walls and clothes being dried inside, but the council still indicate it is down to us to manage the problem.

Does anyone have advice on this or had a similar experience?

With tenants able to challenge rent increases without risk and given how long it will take it is a sort of rent cap.

I feel fur you in this position… have you had any letters from th council to rectify the issue – if not issue a section 21 immediately before the new reforms come in.

If you have received a letter from the council then if you send a section 22 it ill likely be classed as a retaliatory eviction and you will not get it through and you will have to serve another section 21 after the council has signed off the work needed.

I had same issue last year… got letter from council so got the work done straight away within 5 weeks it was all done and council signed off the work… I then issued new section 21 and hit them out.

There may be a 6 month rule to evict in this I can’t remember but just google it.

This will be an ongoing issue fur you unless you take quick and decisive action – good luck, I feel for you.

Sorry I mentioned section 22 in my last message it was a typo should have said section 21

My issues were resolved using passive infrared heating panels.

For condensation damp we have installed positive ventilation, quiet and fan is on all the time. Tenants can’t turn it off. It senses the humidity and adjusts accordingly. We have installed it in 4 properties (bathrooms and general house), good results in all. Linked also to rental increase. Everybody is happy.

We use Envirovent but there are others. They are technically based. Looks like franchises across the UK. We chose to do this, given the landlords exposure.
They will visit, do measurements (humidity etc.) and assess the requirements. We have used 3 models.
1. Cyclone 7 in the bathrooms, also one in a very large kitchen Cyclone 8
2. Model Mr Venti Eco2. Whole apartment. Installed in the kitchen (to vent outside) with a duct opening onto the property passageway.
3. Model MEV 300. Whole apartment. Large renovation so were were able to install the ducts to 3 locations inside the ceiling.

Prior to installation we especially asked for humidity measurements and condensation assessment throughout so we could remeasure annually. Interestingly it is the air movement that seems to create the benefit. The properties are within the humidity range. Installation was done very tidily.

For us, it simply sorted the condensation issue.
