Upgrade of an occupied house and moving tenants around?
I am taking over the management of a house. The upper floors have 4 flats. 1 flat has been refurbished and is let at Market Rent (£850 pm).
Another is being refurbished and the remaining 2 flats have very long term tenants paying £400 per month.
Can I legally require them to move around as refurbished units become available and then when they return to their present flats pay Market Rent of £850pm?

Short answer. No. Not unless the tenancies provide for that and even then if the tenants refuse to move you will have to take them to court which will take a long time. Furthermore, they are unlikely to be keen to give up their tenancies at £400pm and more than double their rents.
The fact that you ask this question suggests you need to learn a bit about landlord and tenant law before taking on the responsibility of managing residential property.

Geoff. If, as it appears from your initial question you are a managing agent, I suggest you brush up your CPD and make sure you have professional indemnity insurance in place.
