Tenant Request for Advice and Help
We have been issued with a section 21, I am disabled and my husband is retired. ![]()
We have been given this because our rent was late 3 months out of 6. We do not have the money to move to another private rented accommodation and even if we did it would be difficult to find the right thing, especially with having a dog.
We need a certain type of property, ideally a bungalow as some days I can hardly move.
My husband had a word with the owner in October last year and asked him to let us know if the rent was late again. We never heard anything until this section 21 came through the door. It wasn’t sent by recorded delivery so we haven’t signed anything to say we have received it.
We have the rent for next month but they want us out by 31st of this month, we have no chance.
Is there anyway we can delay? We love it here, we moved from one district to another for this bungalow and the council say they can not house us because of my needs.
Is there anything we can do?
Please note that the late payments were the banks fault, not ours. They messed up as the rent for the house we lived in before was payable on the 11th but the rent for this new property was due on the 1st.
I am really worried now and it is making me ill.
Please can you help this is the only problem we have we take care of the house and when inspections have been done we always get a good report.

It is not my dog you may not have a love of dogs, it doesn’t mean to say all landlords hate them. My dog is a trained helper dog for me. If I did not have him I would be lost. How ignorant you are to tenants having dog . As long as they are well behaved what is your problem with them , i paid a larger deposit for my dog to be able to live with me, I know exactly why we have been given this section 21 and it is not the dog. I am lucky enough that my landlord loves dog. I am sorry Brian Clement but I found you very rude and I am glad I am not your tenant.

I’d say that’s fair enough where you have tenants who are not prepared to take any responsibility for their pet, but if they are responsible owners and are prepared to indemnify the landlord against any damage, that is a rather harsh judgment.
Although my tenancy agreements have a “no pets” clause, I’m normally happy for my tenants to keep one or two well behaved pets. There is also the animal’s welfare to consider – the accommodation has to be suitable for the size and type of animal, and it’s temperament – therefore, this is something of a discretionary judgment call.
There are insurance policies that householders with pets can take out, that pay out if the pet causes damage http://www.moneysupermarket.com/home-insurance/pet-damage/
In addition, tenants can offer a larger deposit, and/or invite a prospective landlord to their current home, so they can see what impact, if any, their pet has.

That’s all well and good for those well off tenants who can pay an extra large deposit and a rental premium, but for low income or DSS/LHA households that is not usually a realistic option, so I can certainly see Brian’s point of view, and I agree with Brian that having a dog will definitely limit the number of landlords that would accept you as a tenant. (I guess that is why there is a need for a specialist “lets with pets” website).

Michelle – just a thought. If you do move out and rent with another private landlord, I would not tell your prospective landlord that you think you’re being evicted.
Your current landlord isn’t actually evicting you – he simply wants the accommodation back, for whatever reason. A section 21 notice is not an eviction – it’s simply an amicable termination of the tenancy.

I visited the “Letswithpets” link and filled in the quote form a couple of times – a policy for a dog is well under £20 a month – not a large amount for a committed and responsible dog owner, even someone (like me!) on a low income. The policy covers vet fees and indemnity for owner’s legal liability for pet damage, up £1million.
Having said that though, I’m not a pet owner and I realise that’s probably just for the “average” dog and policies for certain breeds might well cost a lot more.

I just wanted to let you wonderful Landlords who gave me advice, our landlord has just been round at our request, and sorted out the problem.It was to do with the rent and I took all your advice about the bank whilst the landlord was here we spoke to our bank and they confirmed to the landlord it was their fault they had not set it up correctly in the first place, as we use an account where they put money away each week for our bills so we know how much we have to spend on food etc. They have agreed to give us our banks monthly fee back from July to January as they have made our life a misery by not doing what they are supposed to do.
So we have just signed a new tenancy and we are very happy. I want to thank everyone who gave us positive advice, it helped us greatly so a big thank you to all

That a bank could mess up like that is scary – it just goes to show that no one can afford to not keep tabs on their bank account!
