Tenant Disappeared
Hi, hope I am in the correct place!! ![]()
I rent out a flat using a letting Agent.
I should just like to know the legal position regarding the tenant’s deposit?
Tenant left owing 1 months rent, and had removed existing vertical blinds.
Tenant does not respond to emails, phone calls, etc.
Can I now claim the deposit?

Please remember that if you take Christophers (correct) advice, you can not get a court order under section 8 or 21 because if the property is not the tenant primary residence then it is not an AST (or AT). Anecdotally, sometimes a s8 or s21 will get through if not contested or if landlord can convince a judge it remained their primary (yes your honour, he’s been looking after his sick Auntie for 12 months

Hi All
I just don’t think it is worth taking a deposit anymore for the sake of £400 is it worth the hassle.
Any views would be appreciated. I normally just go in and get the maintenance done.
