Legionella testing on a single private dwelling – really?

I rent out a property which belonged to my mother before she died.

It is a 3 bed semi with an enclosed (multi-point) central heating system. My agent insists I have a Legionella report done on the property. Do I really need one, they have threatened to terminate my contract if I don’t have it done.

Additionally I signed my original contract with the agent, but it has now been taken over by another company, is my contract still legally binding?

This is what I found about gas hobs and Flame Supervision Device in flats, remember that HMO regulations may require them regardless of the type of building. So I expect the lack of one to be coded as “not to current standards” rather than a “fail”.

It is a real shame that they were not make a requirement for ALL new domestic gas hobs at the time, as they don’t add much to the cost of manufacturing a gas hob, but being optional they are often used as one of the thing to separating a expensive range for the standard range.

Since 2008, any new gas cooking appliances bought for use in ‘multi occupancy properties’ (flat, multi-storey flat, maisonette, bedsit, sheltered flat or sheltered bedsit) cannot be installed unless they contain a Flame Supervision Device.
This is not a requirement for commercial properties, terraced houses, detached or semi detached houses.

A Flame Supervision Device makes gas hob burners safer. They detect when there is no flame present on the appliance and automatically switch off the fuel supply. This stops the build up of gas, which if ignited could lead to an explosion or a fire. A Flame Supervision Device is also known as a Flame Safety Device or Flame Failure Device.

If you live in, or are about to take up residency in, a flat, maisonette or bedsit or sheltered flat, any new gas cookers or gas hobs must be fitted with a Flame Supervision Device.

It should be clarified that cold water temperature should be below 20 deg C. Between 20-45 Deg is in the danger zone.

The Legionella risk assessment has been there for years what has changed is that HSE have moved the goal posts and removed the "over 300 litres" rule which in one swift move has bought it into the world of the private landlord. There is no reason why "legally" landlords can not do this themselves all the time everything is going fine. As with most things in this world the moment things go wrong you will need to prove your compancy in doing the assessment. I'd get someone in prices seem to be £65-£80 round my way for a test every 12 months. A woman in Scotland got done for not being on top of this in a sports centre and got something like £18000 fine after an out break ?

The 300L limit was removed in the 2000 Edition of L8 whilst the 2013 Edition make specific reference to Landlords, hence the more recent awareness of the requirement for Risk Assessment in the rental property sector. Concur typical prices are in the region £65-£80 (plus VAT), but nothing in the legislation requiring an assessment every year, so for many this is a "one-off" cost so long as they periodically review and confirm original assessment still valid.

Dont get taken in by agent speak. They probably take a hefty commission on these legionella assessments. Download the Property 118 one and do it yourself. Its not rocket science. Honest. I do it as part of my managed package anyway.
