    The only thing at a quick glance I could find akin to the US definition you found Kathy on whether a rental business is an investment or trade is the following from HRMC website, second part of which needs a tax/property lawyer to define whether this is in our favour or not:-

    The profits of a rental business are calculated in the same way as the profits of a trade. Therefore interest may be deducted in computing the profits of a rental business provided that it meets the following criteria.
    • It must be payable wholly and exclusively for the purposes of the rental business.

    Profits from UK land or property are treated, for tax purposes, as arising from a business. The broad scheme is that rental business profits are computed using the same principles as for trades but the taxpayer is not actually treated as if they are trading. Thus, for example, CGT reliefs for traders are not available

    I was teased at school for Dyslexia My written Grammar and spelling is a joke But I take my responsibly of being a good Landlord to heart
    When I see our investment’s dragged through the mud I do get annoyed
    The haters out there and there are 1000s have little idier of our challenges of being a Landlord Day to Day
    I have tried to reason with haters on a number of blogs but its hopeless
    I am lucky I have looked at my business and I can move over 50% of my properties to a Ltd Co in the next years to come
    Being a NE Landlord I have seen very little Capita Growth in the past 10 years so pound for pound I can move them
    Low values also help with stamp duty and linked sales ect
    I have been astonished how so called educated Landlords can not see the issues in front of them
    I have been told Dyslexic Folk think a little bit different from most there are lots of very good Business men and women who are dyslexic ie Richard Branson
    have never ever taken offended any one other than the haters they are a curse
    I cant believe such hatred and envy excisted but its there
    I am very glad that others read my blogs Yes the Telegraph blog was tong and cheek but it was picked up by some that it was my true feelings
    I have a very dry sense of humour but that’s my way and I will always give a very straight view
    If you don’t like it I am sorry but I wont change my views for anyone
    The good thing about this new Taxation thing is its got Landlords thinking and talking
    We are going to see huge changes (which others at this point in time cant see) but time will move forward and our Cottage Industry and Zombie Landlords will be gone
    Don’t kill the messenger because its what I see
    Change Adapt and increase rents and that’s my motto and its written on my office wall and yes the spelling is wrong but who gives a dam y Maths are good and that’s what counts as a Landlord

    Jon I think this sort of operation will come to the UK

    We are going to see a new Dawn its going to be a bit like the old corner shop versus the Supermarket
    Our World at present is the Corner shop??
    we are gong to go to the Ltd Co Model
    My own feeing’s are we will have a better Business in future years too
