Capitol Riot Suspects Self-Incriminate Just Like Landlords Do Every Day

Many of the insurrectionists who marched on the UA Capitol building on Jan 6th and violently forced their way into the building stupidly live-streamed their activities or boasted about them via social media. So far, those self-identifying actions have helped law enforcement authorities identify some individuals charged

Law enforcement agencies have appealed for information regarding the violence and have begun rounding up suspects. The U.S. Department of Justice now lists 44 federal cases tied to crimes allegedly committed at the U.S. Capitol on Jan 6th. Plus, other individuals have been charged under local District of Columbia laws.

An off-duty law enforcement officer and members of the military, including a member of an Army psychological operations unit, have been identified as being suspects who participated in the riot.

The FBI continues to seek information – backed by a reward of up to $50,000 – about those who deployed two suspected pipe bombs

So what is the relevance to landlords?

Landlords walk blindly into traps set by cunning and frankly evil council housing and planning enforcement officers every single day.

Because landlords are sadly self-delusional about their strict-liability guilt in compliance with the Housing Acts, Planning Act,  HMO Management Regulations and compliance with Improvement Notices and Planning enforcement notices, they think it is safe to talk to their ‘friendly’ housing, HMO and planning officers about the situation and thinking they can talk/negotiate their way out of the situation.

Landlords: Get real. This is like thinking you can chat or negotiate your way pout of a murder charge with police.

All the council is interested in is tricking you into self-incrimination so that hey can prosecute you and fine you £10,000s. Their financial motive (because the council gets to keep all the fines you pay) is immense, and they are the rule-setters, police, judge, jury and dictators of their own fining policy though we see so many cases of them exceeding their own policy just to claim more money!

I seriously hope you are not comparing landlords who are trying to do the right thing with law-breaking rioters in the US. I am really offended by this post and feel it should be taken down. The implication that the rioters are as stupid as us landlords does us no favours - just drags us into the gutter. I will not be using this solicitor who has got us all wrong.

I disagree.
It doesn't offend me in the slightest. It's a comparison to illustrate something - to help people understand a bit more about why they shouldn't trust the councils. There is plenty of evidence to support such scepticism.

No Fiona, I do not think Phil Turtle is comparing us landlords to those thugs in US Capitol building, but he is making a point that like them daringly attacking the white house, there are some rogue landlords who do similar things by breaking breaking the law like when they try to evict tenants with force without a Court Order.
Secondly he is making a point that we should not divulge any more information than is absolutely necessary, you may think that when you receive an inquiry from any of the housing officer of the Council asking for more information, it is no point trying to be more helpful to them than is absolutely necessary in answering any inquiry, since cunningly they will use your own words against you. I learned this through experience, I rang my local council to find out what was their policy on long term empty properties, as I owned one and read in some news that councils will start using powers given to them to slap a compulsory Purchase order on empty properties, so as I wanted to make a general enquiry regarding their policy, when I rang, I was cunningly asked what my name was, and where is the property concerned situated, and I freely divulged this information, whereas, I should have given them fake name and fake address, because in no time they were on to me like a ton of bricks, why was my property empty and they then gave me an ultimatum to bring it into use within 3 months, whereas, I visited this empty property for over 10 years and paid council tax and bills, made it look like someone lived there, yet no one from the council knew that it was empty and i used it as my second home.
Absurdly they said you cannot have your second home in the same street as your main residence, .....yes it really was bought as a second home as I needed more space to store some of my important things near to my main residence, and it was also being renovated at the same time at my own leisure, also bought in view of a long term investment for my retirement.
In the end i was forced to rent it out and get a property license, so it had to be an HMO as I needed access to my stuff and two rooms I occupied as my second home.

Yes so Phil's title is clear, do not self incriminate, you have the right to remain silent. Anything you say may be used towards you in incriminating you further.
The thugs who attacked white house knew they would be under surveillance, and knew they could end up being prosecuted. a sound piece of advise. You see like in my example I should have not divulged my name and the property address as the nature of my inquiry was general, and the idea was if the local council did have a policy of slapping CPO, then I would have taken appropriate steps to avoid this CPO and if required start preparing to rent my house or start living in it as main resident.

Well done Des & Phil, u got to tell us how it could be. Cause once this Covid is over, them Not got a clue about renting Council officers are gonna' be coming look to tick some boxes & put some stuff in the papers how they caught bad Landlord who's stair carpet was falling off. Which by the way, stairs is down to the Landlord even if it's tenants carpet.
I had one last night 830pm, gal's kid put towel in sink & switched sink taps on upstairs bathroom & went out for 8 hours. Come back & 2 inch of water in kitchen, hallway etc.
That will of course be my fault though if Inspectors look & see floorboards going rotten.
Oh & her lights crackling with water in. And she said Why have I got to pay for electrician?

Even if some of you approve of the rioters, you have to agree that they were blatantly and knowingly breaking the law whereas I wish to stand up for us landlords by saying that most are not breaking the law and are being trapped by councils. My point is that landlords are at least trying to stick to the law. Hence the comparison is invalid and supports the Shelter and media view of us that we don't care about breaking the law. I therefore felt that the writer of this article does not fully understand the position of landlords. He would be better to compare us to a group in society trying to do our best.

Well said, couldn’t agree more, the less you have to do with the council, they better off you will be!
