High Court enforcement action against Liverpool City Council

High Court enforcement action is currently underway against Liverpool City Council and enforcement officers entered the council’s Cunard building at 10am Friday morning with allegedly dozens and dozens of Writs to the tune of around £100k being executed for, what is believed to be, Data Protection/GDPR breaches against a landlord specifically in relation to the running and administration of their BTL property.

It’s understood this has occurred because (like many Local Authorities) they either believe the very same laws they are keen to remind landlords about do not apply to them, or they do not expect to be on the receiving end of such matters, consequently failing to allocate resources to deal with/attempt to defend their position.

This, we understand, is the product of months and months of careful planning and pushback against a Local Authority that ran what can only be described as an attack campaign against one particular landlord that refused to kowtow to their questionable demands and who happen to have their city-wide Selective Licensing extension currently before Robert Jenrick for renewal approval (not forgetting LCC is reeling from the Mayor Joe Anderson’s arrest/resignation). They were hoping to be the ‘poster-child’ in what they consider to be the fight against landlords, but seemingly cannot keep their own house in order with, what should now be, administrative basics.

We expect the methodology of what has tripped LCC up to be applied and used by other landlords against their own councils.

A Liverpool council spokesman said: “This matter relates to a civil claim which we are still challenging through the courts, so it would be inappropriate to comment further.”

Sorry, I am rather confused by this. The headline and article refer to enforcement action being taken, including HCEOs executing writs, but on reading the article linked to above it seems there is no judgment to be enforced.

It would seem sensible to wait until the claimant has actually won her case before talking about enforcing the judgment or whether the same methodology could be used against other councils.

It would be good to know the truth of the matter.

The Claimant has indeed won their case…the Liverpool Echo is a newspaper practically written by Liverpool City Council and they have completely mis-reported in an attempt to sow confusion or dumb-down the severity of the issue.

High Court Enforcement Officers recovered a little under £90k, with over £75k going to the Claimiant. This is only part of what is very likely to be further Writs against LCC.

Might I trouble you for a source? It seems a bold suggestion that the City Council is outright lying about it. I wonder if the truth is more complicated?

Also, are you able to give us some more detail about what the case was about? As this was a High Court case (it would seem so, given the amount at stake) I assume the case has been reported? If the case is of wider application to landlords I'm sure we'd all find it helpful to know the grounds of the claim and to be able to refer to the Court's reasoning in upholding it. Many thanks in advance.

At long last this criminal organisation is taken to task.
It makes me think, can all Liverpool LL sue them for this? We have all been subjected to their robbery charges and no help from them was ever received.

Most of my properties are in Liverpool and I can honestly say this council are horrendous to deal with, I knew it would just be a matter of time before something like this happened.

The License scheme was an absolute joke also that helped no one but help fill the councils pockets !!!

Well, that is what I am trying to find out. It certainly sounds like a very useful precedent which could be used by other landlords in Liverpool and potentially elsewhere. But it's worthless to us unless we have more detail on the grounds, and hopefully the Court's reasoning. Perhaps Luke P could help?

I see a line has been added to the article to clarify that Liverpool City Council are still challenging the case through the Courts. It would be good to know the final outcome so we can be aware if and when a binding precedent has been set.

I am Shaun Maharaj the landlord who yesterday instructed court enforcement specialists (CES) to send their team of high court enforcement to raid the offices of corrupt Liverpool city council.
For the avoidance of doubt I state that Liverpool council lied to the echo. There were a total of 49 writs executed and almost £80k retrieved plus costs. The writs were sent up to the high court as the rogue council refused to discharge county court judgement. These judgments can be viewed as unsatisfied on registry trust. This council has more judgments than any local authority anywhere. As regards Liverpool's statement that the matter was still under dispute in the courts, this is a blatant lie. Enforcement's agents cannot attend unless judgments are already in place. The council are insulting the intelligence of the public. Finally i can confirm that numerous other cases and litigation are in train and as these separate cases are still before the courts, it would not be appropriate to comment suffice to say that Liverpool also has a £40k legal bill to pay me for failed/ fraudulent proceedings against me which collapsed in the Queen Elizabeth law courts 2 weeks ago. Liverpool are squandering tax payers money on their failed vendetta against me.
