Hi Shaun, congratulations on your success and good luck with the rest of your litigation.

However, we are assured that this is a precedent that many other landlords could follow, but we're still in the dark about the grounds - also as a County Court Judgment it is not binding. Did you get judgment by default or was the case decided in your favour after a hearing? If the latter it may still be persuasive on other Judges.

I'd assumed it must have been a High Court case as sums in excess of £30,000 cannot be litigated in the County Court, but I guess there is more than one case involved.... Read More

Well, that is what I am trying to find out. It certainly sounds like a very useful precedent which could be used by other landlords in Liverpool and potentially elsewhere. But it's worthless to us unless we have more detail on the grounds, and hopefully the Court's reasoning. Perhaps Luke P could help?... Read More

Might I trouble you for a source? It seems a bold suggestion that the City Council is outright lying about it. I wonder if the truth is more complicated?

Also, are you able to give us some more detail about what the case was about? As this was a High Court case (it would seem so, given the amount at stake) I assume the case has been reported? If the case is of wider application to landlords I'm sure we'd all find it helpful to know the grounds of the claim and to be able to refer to the Court's reasoning in upholding it.
