I want my tenancy to remain periodic but …

I’ve received a letter from my letting agency (not going to name them) saying that the guidelines and regulations have changed regarding my tenancy going to periodic. I want my tenancy to remain periodic but

I pay monthly so does not seem to make sense to me. Then it goes on to say I might, in the next few months, have to sign a 6 months tenancy and thereafter it will change back to monthly after that all because of this change.

I’m not happy with my landlord as I have been in the property for 2 years and have asked for work to be done (basic maintenance to the building such windows and damp which is up to him as the landlord) and nothing been done. Due to my circumstances though I’m stuck here for now.

Can they make me sign this 6 months agreement?

They have breached their side of the contract and it seems the law favours the landlord.

I’m stuck and would like advice as I have always paid my rent and due to my current position I would find it hard to move so I’m stuck in catch 22.

Any advice please would be much appreciated.

Thanks for your note IO. I give them the certificate, with their prescribed information on the back and then the Information for Tenants leaflet that they also issue. Isn't that enough? It is all from mydeposits and nothing extra so now I am worried!! What else is there?

Hi Gilly. My understanding is exactly the same as yours with the only difference, I send the PI on a separate sheet vs the back of the certificate so's it stands out. Plus 2 copies of the certificate duly signed by us as the landlord with a covering letter (of which I keep a copy) explaining a summary of the enclosures & for the tenant to sign both certificate copies & return one copy in the stamped addressed envelope provided. This letter plus content is first posted by ordinary post & followed up by my agent by phone if I don't receive back a signed copy (which simultaneously confirms safe receipt by the tenant.. Returning a signed copy of the certificate isn't a pre-requisite to my understanding, but best practice & if the tenant is lacking in returning a signed copy, I at least have the covering letter as evidence it was delivered (& a file note of the follow up phone call). In that way the tenant can't prove ignorant having not received it.

As said in my email, I would attach a copy of this document with your resume for agents & potential landlords to see how committed you are in paying your rent on time & with the help of your father, maintaining your tenancy property to a good standard of repair. Morning ok thank you i will check emails, i am keeping it in a good state, well trying ive got paint to freshen it up but carnt do that yet as the walls are wet, but hopfull with all this information i can get it sorted 🙂 and thanks you once again.

Meaagage to Michelle from my holiday in Egypt. Further advice, go to your local newspaper with your story and make sure you mention the things you have in your favour as discussed in this thread. I reckon you could have landlords falling over themselves to let their properties to you and avoid agent fees. Please direct them all to this thread when they make contact.

The PI is always best as a separate document, even if 'separate' within the tenancy agreement. Never let it get tangled up with anything else that a Scheme simply wants you to issue on their behalf.

Be EXTREMELY careful about going to the local press unless 110% absolutely certain of your facts. Malicious falsehood is easy to commit, and from there it is only a short step to the much more serious charge of libel, especially when dealing with a business with deeper pockets than your own.

Thanks, that's a good point about keeping the information on a separate piece of paper rather than printing double sided - I suppose court cases have hinged on stranger things than that! At least the documentation reduced recently from 8 sides of A4 x 2 (plus a folder full of stuff that I always provide) to just the 4 x 2.

Yes I do two copies and get the proof, as I normally make sure the deposit is paid just before the moving in date, so that I arrive on the day complete with the certificates etc in person, which we both then sign. (I have often sent it all by email in advance as well). Otherwise I return asap - but always in person. (I like making work for myself).

Still worrying though, as I have just noticed on the RLA website that this is not deemed to be sufficient. They produce an excellent form (with a further umpteen pages) which gets the "contact address" actually signed/verified (I'm learning IO 🙂 and specifies a list of items for which deductions from the deposit can be used. I normally just have the contact address on an informal "details form" which they fill in for me. I think much of this is covered in the NLA AST agreement which I use, but I may start to add it to the mass of stuff that tenants rush me through, when they just want to get on with unpacking..... to be on the safe side, wherever that may be.

Hi Mark, enjoy your holiday you lucky so and so :/ but as for the paper id rather not have my personal business in my local paper :/ as much as i dont have anything to hide and done everything ive said on here, id still rather not but thank you.

Hi all again sorry to be a pain, im just doing my folder up incase i find somewhere, Looking at my Tenacy Deposit Certif, the 1st one i got when i signed up it say between the land **** ****** and the tenant me, Beginning on the 5th April 2012 and ending on or after the 5th October 2012!!
On the one they have just sent me the only differences is they have changed the ending date to: Ending on or after "periodic". So im confusing myself that just means the same as before then when i give my month's notice and they issue me with a month's notice????? am i getting that bit right please?? Thanks
