Tenants are not evicted for no reason

The RLA has conducted its most wide ranging landlord research yet concerning government announced plans to ban Section 21 so called ‘no fault’ evictions.

The research included feedback from over 6000 Private Landlords and strongly contradicts the Government, Press and Shelter assumption that the majority of tenants evicted under section 21 are for no fault.

The following reasons were given by landlords for using section 21:

  • 84% because their tenant hadn’t been paying rent
  • 56% because of damage to property
  • 51% because of anti-social behaviour
  • 26% said that they had served a Section 21 notice at the tenants’ request to enable them to seek social housing to avoid them being classed as intentionally homeless

84% of landlords said they would be ‘more selective’ selecting tenants if the government bans Section 21, because of the fear of difficulties and time involved in gaining possession when something goes wrong. Therefore, this would marginalise further tenants that need the most help such as DSS or any prospective tenant who cannot pass a reference/credit check and does not have a guarantor.

I doubt the government will take any notice of those figures considering they have already announced it’s going ahead regardless in the frantic chase for generation rent votes

Problem for the Government is those generation rent voters will vote Labour. They’d actually do much better trying to increase the vote from conservatives rather than turning themselves into lefty liberals.

I suspect that the RLA got the answers that they wanted because they asked the people whom would give them the answers that they wanted - landlords/professional landlords. If you could somehow widen the survey to include amateur/casual landlords who briefly find themselves with a property which is surplus to requirements so decide to rent it out for a short period they would get much more accurate figures.

I agree with Gary. My son lives in London and he just been served another section 21 notice after moving in this January exactly 6 months. This is his 8th move being served S21 every time. He is a very responsible tenant, maybe too honest. He payed £750 agency fee which he loses every time not mentioning the constant stress of not knowing when you’re asked to leave. I hear same stories from his friends. Some Landlords don’t consider the social impact of their selfish actions. It is this widespread abuse that lead to S21 be abolished.

If the survey were widened to include amateur/casual landlords, how would the results differ from the RLA’s figures?

I am a 'casual' landlord with two properties obtained through family members passing away. The ONLY reason I have had to evict anyone is for not paying their rent, followed by them trashing the place. I rarely put up the rent, if they are a good tenants, and replaced appliances regularly!

Same as Robert: I am also a 'casual landlord'; the ONLY reason I have had to evict anyone is for not paying their rent; I have also experienced damage to the property; I have considered evicting people due to antisocial behaviour (by which I mean behaviour that upsets the neighbours...I try to get on with the neighbours).

So the RLA figures look reasonable to me. I think they ought to reveal more details of how they conducted their survey.

I think the RLA survey did ask the question as to what sort of a LL you are. And I don't understand why a LL would evict a good tenant, especially if they are using an agency to find/manage them as the costs are so high. If a tenant is paying £750pcm and a tenant find free is 5%+VAT that's £540, plus referencing, AST, deposit protection, check in/out, void (mortgage, council tax, bills), RGI and any refurb necessary. It doesn't make financial sense! It would be interesting to know if S21s were served due to LLs selling.

I will try and find out. Agency gave no reason. My son is an ideal tenant, always pays on time and strictly stick to rules, very sociable, honest and considerate. He just wants to settle for a few years where he knows he is not going to be kicked out a few months down the line for the 9th time in just a few years. Now unless he is so unlucky I assume there are a lot of young people in same predicament.
