Tenant refusing access for gas safety check?

Hi, my tenant finally agreed a day and time access for an annual gas safety check. However, because the tenant took so long to respond the engineer could no longer accommodate on the said day and time.

The agent is making contact with other engineers for their availability but the tenant is no longer responding. Agent fed back he was angry the appointment was no longer available. The booking was not short notice – a week in advance and lots of emails prior to this saying they would be booking this in as it was due.

The agent is emailing and calling the tenant. I have suggested sending a letter advising its for the tenant’s safety. Is there anything else I can do? The certificate expires Friday 18th October 2024. Should I contact HSE?

Just keep the screen shots of the txt messages and emails as a proof .

As long as you tried 3 attempts more than enough to show that the tenants not cooperative and later you can complain to local authority

Applying court injection is another expensive option

I had this issue during Covid, our gas engineer said as long as you have proof of attempts of communication then you should be fine.
I've added in my tenancies a notice to help prevent such issues.
"Notice giving permission to the landlord to gain access for gas safety inspections
By signing this agreement, you confirm that we may use our keys to provide access to our Gas Safe Registered gas engineer for the purpose of carrying out the annual gas safety check, so long as you have been given not less than 24 hours’ notice in writing. It is agreed between us that this permission can be revoked by you, so long as you give us not less than 24 hours’ notice in writing."

If the tenant doesnt respond you can then attend and keep proof that they were notified. However if they do revoke that access then you have to try again and keep the records.

Thank you so much, HSE were really helpful. I will ensure agent has all correspondence and I’ve sent contact emails I’ve had with the agent.
If the tenant does respond - agent was quoted £150 for boiler and gas fire!!! Last year it was £90 there are no appliances to check. Am I right thinking £150 is way above average? I’m in the north Leeds.
What happens when the certificate expires? Do I continue to attempt access or leave it if I have the proof?

What would the local authority do? Is it worth logging this with them regardless - I’m serving s21 in March to sell. If we go to court?? would it be seen by the judge being proactive and in my favour?

I am charged £90 (inc vat) for an annual gas check for properties in the Midlands area.

I always set the time and date of gas safety checks with my plumber. I then notify the tenant of the date and time, giving them the option of attending or not. I always meet the plumber at the property. I give the tenants a minimum of 2 weeks notice, i give them no say in when it will be carried out. I have not had any issues in the last 30 years.

Thank you. My tenant insists on being there even when it is an external visit.

I’ve offered to be there through the day but he has declined. The agent has also offered to meet the engineer too. He has declined this saying he wants to be there. It’s like this every time we arrange any visits to the property.

When the agent finds a gas engineer not many will go early teatime. The tenant wants 6pm. Some gas engineers will not give a specific time as they are experienced with tenants not allowing access if they are 5/10 mins late or there is no answer. Tenant is still not responding!
