Should I go for a Section 8?

Hi all, I need a bit of advice? So, I’ve just had to cancel a order on a Section 21 because Shelter defended an incorrect 6a form that I used (I used a well known landlord site which I’m a member).

The tenant is also in rent arrears which we said we wouldn’t chase if we did a Section 21 and we gave her 5 months notice of our intention to sell (Nov 24), so in April we served her the 8 week notice.

The tenant sought advice and was told to stay until the bailiffs arrived.

Would we be best now going for a Section 8?

I am new to this – it’s the first time we’ve done this in 25 years being a LL.

She has had it adjourned to prepare her defence 🤣🤣🤣which is a phone call we made to her telling her to only pay £490 🤣🤣🤣 oh and also a witness statement I’m assuming to the said phone call ? So hey ho it’s off again to court we go 😡😡😡

    Sorry to hear that. Very frustrating. You’d think the judge would expect the tenant to come prepared if the ‘evidence’ exists.

    That is outrageous! It’s just so frustrating and unfair!! But I guess the judge has to make sure every process is followed correctly – before gladly evicting her! How long has she been given to magic up this evidence? Is she going to produce a recording of this alleged phone call (which I would question for it’s legality) or just a (made up) written statement swearing she received said phone call?? Besides which, as I already said, she hasn’t paid you ANY rent, so I can’t quite understand her reasoning. Just shows how the system is bent in their favour though…. But I’m still pretty sure you’ll get the possession order next time.

    Me too but her fence is a witness to the imaginary phone call we had so let’s see how tha pans out an thanks for your support appreciate it 🙏🏻
