Should I ask my tenant to leave or serve a S21?

Hi. I would like my tenant to leave at the end of their fixed term agreement due to a number of negative reasons like damage to the property and keeping a dog without permission.

To save serving S21 can I ask my tenant if he is leaving and wait for his written notice. If they don’t provide notice, I’ll serve a S21.

Also any advice please regarding agents. Does my fully managed contract automatically come to the end of the fixed term end date? I am thinking of either managing the property myself or going to tenant find.

    I doubt he’s leaving. These difficult ones never seem to leave. He’s got his dog there and he’s comfortable. If I were you, be proactive and serve the notice. Theres been good advice on the thread. The only thing I wanted to add, was that you are paying for a agent to fully manage … get your moneys worth and make them manage. They found him, make them deal with him. Do not switch agents mid stream and do no self manage until he’s out. Agents need to do the job they’re being paid for. I know you said you have to oversee everything but that’s micro managing and you have to make them earn their fee. There’s no way I’d be going with them to the property. Its what I’m paying them for. And you don’t want the tenant to take one look at you and think he can take liberties. Better to remain at arms length and deal with it via the agent. Make them do their job!

    Serve section 21 now… it’s the legal way of asking them to leave and it fully documents the request…. To simply ask them to leave is certainly and indication you need some landlord training as mentioned in a previous post and this game sadly should not be for you when the new rules come in.

    Thank you Londonlad. It’s been awhile since I have responded. Joining this platform, subscribing on YouTube and listening to lots of podcasts has been a great help with regards training. I am very conscientious in ensuring my agent is diligent and I think some subscribers on here take this as a negative and presume I do not understand any of the legislations, you are not one of them so thank you!!!     Indeed, Happy New Year to you too. Unfortunately , in over 30 years renting property the only bad tenants have been those provided by agents. I tend to find my own tenants now but if they are introduced by an agents then I still carry out my own due diligence. Many agents just want their cut……
