Hi all, I have a new tenant who’s been in for less than one month since January and just found out they have dumped furniture onto next door’s drive.
The owner is away and has sent me a message saying this needs to be cleared, as they gave no permission for the items to be left there.
I have left messages and rang the new tenant, but have received no reply.
Has anyone come across this themselves and know what to do?
Can I terminate the AST? Do I need to issue a Section 8 notice?
Any advice would be greatly appreciated.

Sadly there is no quick way to terminate a tenancy and because of the Section 21 rules you have missed the opportunity (can’t be issued in first 6 months which is beyond the end of Section 21).
Was the furniture yours, if not why would a tenant be dumping furniture – it may be a random fly tipping and just blamed on your tenant.

unfortunately the last tenants left it there and also I believe they have removed some of the fixed cupboards in the bedroom without permission. Agent carrying out inspection next week.
There is also a six month break clause in the contract.

So items were left in property when new tenant moved in, were items listed on ingoing inventory? Why did tenant not just tell agent and ask for items to be removed? Also removing fixtures without permission.
Dumping stuff on neighbours property is still fly tipping. If neighbour has proof they could report to council.
If the neighbour can provide you or agent with proof of the fly tipping I would think that even within the fixed term you could evict for ASB, Section 8 Ground 14 I believe, and there maybe another ground to cover removing fixtures which could be used aswell. Maybe ask agent to take photos when they inspect.
The tenants behaviour would be red flag for me, fly tipping and removing fixtures, obviously no regard, what will they do next?

That’s my fear what else will they do.
We have two neighbours indicated they did.
Will look at section 8 and see how it can be applied.

This is between the tenant and the neighbour but if you think its your furniture and its still usable, I guess you might want to reclaim it.

I’d be wondering why the agent didn’t carry out an inventory before returning the deposit and deduct the cost of removal of outgoing tenants unwanted furniture.
And inform you.
The poster said they ‘believe’ fitted wardrobes also removed by the current tenant. So the agent not carried out an inspection?
So the agent has to inform current tenant that cost of replacement will be deducted from their deposit and serve notice that any further damage to landlords property will result in eviction
What service is the agent being paid to perform?

Check out inspection was carried out but for some reason. The agent said the last tenant has cleared it. But now obviously not and the new tenant moved in.
Waiting for inspection, and see exactly what they have removed. But I believe it’s the back bedroom fitted cupboards from the pictures sent to us by the old neighbours we know. They are keeping an eye on the new tenants.
So waiting now.

Most unusual way to do business. I fear that you have been negligent and irresponsible whilst the tenant may be criminally liable.

Check out inspection was carried out and the last tenant indicated they would remove any of their item but clearly left some, agent to carry out another inspection this week.
Nothing negligent on my part, new tenant seems to think they can remove fixed cupboards.
