New 'How to Rent' Guide!

New ‘How to Rent’ Guide!

I’ve done a couple of tenancies today and the ‘How to Rent’ guide this has changed in the last 20 minutes!

I wonder what would happen if I had actually signed both of these tenants up today with one before the change and one after?

The new guide is also now eleven pages (up from eight? previously). I am going to have to go over it with a fine-toothed comb now. See link below:

https://www.gov.uk/government/publications/how-to-rent

There’s also a matching ‘How to Let’ guide aimed at Landlords, which I believe is a new addition? See link below:

https://www.gov.uk/government/publications/how-to-let

“How to let

This guide is for current private residential landlords and anyone interested in letting a property in the private rented sector.

Details

This guide is for current and prospective landlords. It explains the responsibilities, legal requirements and best practice for letting a property in the private rented sector.

It is not intended to cover leasehold, holiday lets or ‘resident landlords’ who let to lodgers.”

Regards

Luke

Its like they just want to do as much as they can to make it difficult if you ever have to go to court..

Really appreciated Luke for bringing this to our attention. Why on earth we’ve not been told by even the likes of the NLA or RLA who should surely know, G_ knows.

The document states “Landlords cannot use the Section 21 (no fault) eviction procedure unless an up to date version of this guide has been provided to the tenant”. Does this mean we now have to issue this new version to existing tenants where an older version has been issued ?

That was going to be my question. All my tenants were in situ before the first booklet was produced. I gave them each a copy when it came out, as it seemed the reasonable thing do so. So are we expected to check .gov on a daily basis to locate new booklets!

That is something that definitely needs clarification!

It’s also now part of a series of ‘How to…’ guides:

    How to Rent
    How to Let
    How to Lease
How to Rent a Safe Home

I feel like they’re gearing up for Scottish-style standard tenancies and Welsh-style RentSmart England.

They all need to be given the new guide apparently.

The guide does not supersede law, and the law is that the current version must be given at the start of the tenancy and if a new one is published during the tenancy, then it does not need to be supplied.
See The Assured Shorthold Tenancy Notices and Prescribed
    Requirements (England) Regulations 2015
    ; in particular paragraph 3.(4)
