Making Tax Digital exemption?

HMRC Making Tax Digital screen with tax exemption documents, illustrating an MTD exemption for a landlord

Hello, I am an older overseas landlord and due to my age, 80 years, I have recently experienced severe health issues.

In fact, if it wasn’t for a fast emergency response from my local hospital, I most likely would not be here today. I had a severe bout of COVID which left me with blood clots running round my system. This resulted in deep vein thrombosis and a pulmonary embolism.

Having read an account of another landlord’s successful efforts in obtaining an exemption from Making Tax Digital, I thought I would try for the same through my UK accountant.

He sent a letter on my behalf, asking for an exemption on the grounds of age, health and ease of computer application issues. I am happy to say that I have just received a letter granting me an exemption on the above grounds. So if there are any other landlords out there in the same or similar situations, I would advise them to try for an exemption. You never know; you could be successful. It is worth a try.

Have there been any more successful stories of landlords gaining a Making Tax Digital exemption?

Thanks,

Patricia

I’ve heard if you registered with HMRC as a joint partnership then you are exempt under current rules for registering for MTD. Handy if your a husband and wife team. Perhaps someone could confirm if this is correct.

My accountant insists that property partnerships can’t be registered as such with HMRC as property is considered an investment and not a business.

I have written to hmrc twice in the last 7 months requesting an exemption to MTD but have not received any reply. Can someone please tell me the correct address that I should use for my third attempt

As a landlord, I would have to question the wisdom of allowing anybody to avoid legislation due to age or infirmity. If there were to be a serious problem with their property, their tenant would need someone able to react quickly amd efficiently. If they can do it for their tenant, they can do it for us taxpayers. If they can’t, and don’t have someone able to act on their behalf, then they they shouldn’t be landlords in my opinion.
Being a landlord comes with responsibilities.

Your accountant is talking nonsense, I have registered numerous clients as partnerships. You can have investment partnerships.

Also, whilst HMRC will generally not accept BTL as a trade they will accept it as a business.

I have a UK accountant plus a letting agent. If I was to be taken ill and incapacitated they would be able to step in. Plus I have 2 UK children with power of attorney over my affairs. I think this gives plenty of protection in case I was suddenly to drop dead!
