Hello, tenants were due to vacate the property this weekend. However, the tenants have told the management agency that they have been advised by the local authority to stay put as they are a couple with a young child.
Where do I stand on this? Any advice would be greatly appreciated!

This is the real problem….unless it’s passed as law LA’s just apply their own rules and doubtful B Lewis’s recommendations with hold any weight. As previously stated….their simply isn’t enough LA homes to satisfy demand.

Yep we have been told the same……served a section 21 which has been served incorrectly….forced out after 4years as we didn’t agree to the £200 increase in rent.

Sorry but I didn’t agree to increased energy costs, or insurance increase of 34% or licencing costs…..
So what makes you think you have to agree a rent increase? Life for a lot of people is not good at the moment and I don’t think anyone gets to pick and choose – even us hated landlords.

A s21 notice is just notification that you are intending to repossess the property and the move out before or on date is a fingers crossed the tenant(s) will move out.
Next step is to apply to the Court for a Possession Order.
The council will probably advise the tenant(s) not to move out on the Possession Order date too.
Your next step then is to apply for a Bailiff’s Order.
The tenant(s) will then either move out before the required date in the Bailiffs Order or the Bailiffs will evict.

West Lancs council told us not to leave. Think it’s the general consensus that councils will tell you to wait, as there’s a shortage of council housing stock. We got offered a house before our notice to quit was up, after just 5 weeks of being on the general housing register, but I know in places like London the waiting list is around 10 years

Local housing offices have been telling tenants this for years, it’s nothing new. I’ve just sent N119 &. N5 forms to the court for eviction of a tenant whose been there 6 years without issues (single working man). He’s suddenly turned into a monster, become totally mean & uncooperative when as a 77 years old I wanted to sell up. One big problem tho, I don’t know if he’s had the Help to rent book, he had the energy cert and I lodged the deposit. There’s been 2 different agents and 3 tenancy agreements along the way but he could still go to court and say he didn’t get it then I could be snookered. Any advice on my chances with the judge please?

Judith ….here’s one….Shelter advised my recent tenant that when the bailiffs come she could simply leave her stuff in the place and I had no right to touch it. She left her stuff in for over 2 months post eviction – I couldn’t let the place out or do anything with her stuff for fear of being accused of taking anything. Had to pay the rates bill and other costs whilst vacant. Everything is stacked against decent landlords….she never paid the court fees that the court instructed her to pay. I was just relieved she was out.
This is a legal right apparently….that was after a 9month s21 process last year dealing with tenant from hell. THANK GOD MY PAPERWORK WAS IN PERFECT ORDER. I had her sign receipt of everything – Hiw to rent, gas certs etc. Left no angle open. She made the lives of everyone in the block of flats a misery. But impossible to get her out on antisocial grounds. S21 only route. Really concerned what future holds for these kinds of situations going forwards.
Judges always apply any discretion in tenants favour in my over 25 years experience. That’s why I liked the s21 mandatory possession.
You know now I’m just grateful to get places back now so I can sell out. Too much hassle and odds against good law abiding landlords. Just had enough.

Yep – me too. It’s annoying that all we can do is complain and then leave the sector. The good tenants are already missing us but gen rent and Polly will never see it until it’s too late.

My tenant told me that LA said them to stay in the house until they get the eviction order from court!
So my tenant was very confidently asking me to serve the notices for eviction.
Kept saying that “illegal and illegal”
I really need the house for my two young children who started university and will start within 3 months.
