Landlord intimidation – now is the time for action

I am aware that a lot of landlords on this site have faced some of the same problems with councils that I have had to endure over the last several months. Such as giving tenants legal advice (they are not allowed to do this) and lots of other problems that they try to intimidate me with making up the rules as they go along.

I Googled “how to take the councils to court” the results where shocking not just for landlords, but for tenants too. I have therefore decided that enough is enough, I emailed my MP yet again to no avail, he said he would take it to government ombudsman. I laugh because he made this suggestion to me a few months back and the reply I got was a nameless guy on the end of the phone laughing and saying” MPs are bl##dy idiots they make the bl##dy laws” quote un quote.

So I am now in the middle of yet another dispute with another council and have come to the conclusion that the only way forward is to allow them to take me to court!!!

This is the only way that I can think of to get it into public arena and whilst I could do without the grief they will I suspect be really upsetting some poor judge for waste of court time and money.

I am now asking for as many of you as possible to back me on this. Just send me your stories etc, I have already emailed my MP and one of the chief executives telling them that this is my plan and it is now up to my MP to finally pick a side and move forward, so please ANY help or stories please comment below. I am a GOOD landlord which many many tenants will attest to. My tenants live in much nicer houses than I do simply because I realise that it is them that is keeping the roof over my head, but the good are being targeted and the bad just let go.

Hi

We are using the services of Mark Smith (Barrister-At-Law) - CotswoldBarristers. He would be a useful start and very helpful. Our run in with the council involved a tenant who stopped paying rent. Speaking to the council in Midlands was no use. the tenant then informed me she was being advised by the council on what actions to take, for example
1) take the matter to court you will buy time this way
2) second not to leave property earlier then she intented as she would need a court order to throw her out of the property, only then would the council look to rehouse her
3) Pay back minimum amounts of the rent , so she used to pay £5 in some months

We ended up having several thousand pounds in rent due, and it took almost two yrs to evict her. Not to mention legal, and other sleepless nights.

If thge councils are allows to get away with it in this way then anyone would right

Hi I would love the choice of using legal professionals sadly tho due to the hell i have been thru it is simply out of my price range as i suspect it is for many on here as the money i have lost pales into insignificance compared to others on here, I hope things go well for you and maybe you can pass on some tips...I have contacted courts today re the council tax liability they have landed me with, I can see some big mistakes they already have made so quite confident on this point which i think will help with any future court appearances, I have yet to hear back from my MP but will direct him to this site when i next name contact. I am trying now to let go of the anger and concentrate with each problem 1 by 1, it is bard not to get angry when i see how others are suffering but it would be helpful if everyone shares on FB Twitter etc as i have had many supportive messages which is keeping me strong..once again good luck with your case and plz keep us updated Thank you Sharon

Sorry Andy is that yes it was you that started a petition on here, or yes to last comment?? If its yes to the petition can you update me on what happened with it??? I think that could be very useful for me to A) send a copy to MPs & 2) The court case that I intend to pursue, I am not quite sure how to transfer it from this site to MPs so I am going to try just sending the link to him failing that I will have to copy & paste....
I had my electric certificate done today pronouncing the house & the rear living accommodation safe & secure (wasnt sure the outhouse would be so straightforward) I am now getting a health and safety engineer to write me up a report re: ceiling etc but do not propose to disclose that information at this time, think il just make them look stupid in court on that one & tomorrow I plan to put in yet another formal complaint naming names including first & foremost the rottweiler arrrggghhhh!!! Just thinking about that woman sends me into a rage! I will also be stating that I intend to sue them for compensation for all the money I lost due to their interference & the lies she told but most of all the fact that she had contacted police giving MY name & to be on alert for absolutely no reason whatsoever I never thought I would say this but I want her out of her job or I WILL without question fight this to the bitter end & I am going to see if I have grounds to sue her as an individual as I am sure even the other deadbeats in the council would not have sanctioned that.
And have arranged a meeting with the manager of housing for next Monday, so please continue with your comments and any experiences you have had & I will continue to update you all as often as possible.
One last thing please share this on FB Twitter etc, I was not going to bother as I had "landlords" as friends but I did & have had a great response PLUS it give me an excuse for my rants hehe xxxx onwards & upwards Thanks for your support xxx

Hi Neil do you know if ALL eviction notices are taking much longer than normal, I am in process of one & it has taken mths to get before the judge at Guildford/Staines & I found out it went before the judge on 27th June but they have a backlog of typing these orders up THEN Hounslow council want a bailiff order as well meaning that it has now taken approx 4mths not including section 21 & I have to give it back to the courts for the bailiff order so god alone only knows when that will be, I cant believe it I have already lost one potential tenant as they needed to move on certain date that should have been well within the time limits but was not & now I have another tenant that I am going to lose if this carries on any longer. Meanwhile back at the ranch im losing income hand over fist & much longer & I will lose the house. Is anyone else experiencing this kind of nonsense??? Its not like you can take the court to court, I have put in an official complaint & not a dickiebird back

We need to have "accelerated possession orders". Should be done quicker with a mediator, within one month after expiry of Sect 21 or 8. It just takes too long!! We need MPS on our sides. We should find out how many MPS are LANDLORDS???

Good for you Sharon. I took my district council to the Ombudsman last year about s21s. The council and their solicitor blatantly lied and the Ombudsman was toothless. They will lie and use dirty tricks to cover their tracks. Arun District Council did things like saying they didn't even have a policy on Homelessness so couldn't be breaking any of their rules. But they have to have this policy by law and it was actually on their website. So they deleted it. When I sent the document to the Ombudsman they said it was a draft (it didn't say that) and was published in error. Even though it had been on website for 3 years, the Ombudsman accepted this was a mistake and accepted their apology. They still disputed this advise was given out by them and rubbished my evidence all the way until I got all the local agents to all back me up. They then accepted this advice was coming from their offices but it was due to a verbally agreed policy of the County Councils who contracted the homelessness advice and so after spending 18 months fighting my complaint it was thrown out because I should have directed it to the other council.

I spoke to the National Landlords Association and they seemed interested in taking a test case. But they wanted to be involved right from the start. Worth a call.
