Have I been scammed into Leasehold?

Have I been scammed into Leasehold?

9:30 AM, 9th July 2021, 5 years ago 69

I have just purchased a house from an auction and the legal pack said the house was Freehold, even Land Registry right now says the house is Freehold

However, only one day before the auction, the auctioneers put a document in the legal pack saying it has a 999 years Leasehold.

How can I solve this issue?

What are my rights at Auction, and have I been scammed?

Thank you for any assistance

Andrew

The legal pack would contain many documents that could be remotely related to the lot being sold. These may be historical showing the whole trace of title deeds deduction, these may have the original title the lot is a part of. Leasehold sales will always include the freehold office copies together with the lease conditions. Yes, you may be under impression that you are buying the exact same property that the latest Office Copy is referring to, but in fact the contract and the special conditions thereto are the most important parts. There are always Special Conditions for an auction property and one can’t rely on the legal pack without those. Unfortunately it’s what you learn the hard way.

Again, if you have a record and can prove that the “Additional Info” tab said “Freehold” originally, you may have a case against the auction. But this would’ve likely been only for your pre-auction expenses, like solicitors and survey cost that you wouldn’t have incurred had you known the property is a leasehold.

But what’s the full story of your bid? Did you see the changes and decided to buy anyway because you thought the “leasehold” clause is a mistake? Did you not pay attention to the last minute changes at all? Did you ask the auctioneer to proxy bid on your behalf?

last minute changes are not acceptable in any universe.
what about them changing 50.000,00£ to 50.000.00£ only a dot(.)?
    come on now..

i just bought a house which was shown as a freehold and turned in to a leasehold, cant understand your point.

With the information available now, it’s clear that the lot is sold as a leasehold. The main question is: was the same information available to you when you made the bid? Last minute changes however small is not usually something you can argue about — if you don’t like the dot, don’t bid.

    thanks for your lovely information

again its about changing information about lots in last seconds or day. freehold or lease hold or even a dot change can make a huge difference.

hope you can sense the difference a dot made in my above information because you seem to not catch that.

missleading information and showing something that isnt reality cant be acceptable.
last minute changes is again just a type of scam.

Andrew do you have the details of the landlord, and the managing agents? (I can’t access the pack as I’m not registered for auctions)

if you wonder what was available at the time,

“addinitonal info” section did not have a tenure part and the last 2 documents were not available untill hours were left for the auction.

so maybe you can sense it out

I signed up & accessed the pack, I can see the freeholder is the council, no MA info, did you get paperwork other than what is available online?
