Andrew, I understand the situation and feel your frustration. It is very likely that the tactic used was a deliberate intent to mislead, however you are very unlikely to be able to prove this. I can only imagine you would have a remote possibility of a recourse if you made your bid before the changes were published, for example if you instructed the auctioneer to bid on your behalf and they then failed to update you on the changes to the legal pack. The legal pack would contain many documents that could be remotely related to the lot being sold. These may be historical showing the whole trace of title deeds deduction, these may have the original title the lot is a part of. Leasehold sales will always include the freehold office copies together with the lease conditions. Yes, you may be under impression that you are buying the exact same property that the latest Office Copy is referring to, but in fact the contract and the special conditions thereto are the most important parts. There are always Special Conditions for an auction property and one can't rely on the legal pack without those. Unfortunately it's what you learn the hard way.

Again, if you have a record and can prove that the "Additional Info" tab said "Freehold" originally, you may have a case against the auction. But this would've likely been only for your pre-auction expenses, like solicitors and survey cost that you wouldn't have incurred had you known the property is a leasehold.

But what's the full story of your bid? Did you see the changes and decided to buy anyway because you thought the "leasehold" clause is a mistake? Did you not pay attention to the last minute changes at all? Did you ask the auctioneer to proxy bid on your behalf?... Read More
