Ground rent notice not received by 18 lease holders?

Long story short, we had a new landlord who was late sending the march ground rent out and 18 leaseholders did not receive it. We did not know who the new landlord was or any payment details.

We made a joint complaint to PDC (property debt collection) who very quickly got involved and even asked our local MP. A year on all but me were forced into paying £925 to stop their credit score from being affected and to end the bullying.

I will not be bullied into paying this with all the evidence I had supplied and a financial disclosure.

How do I get them off my back? I never refused to pay it but the landlord refused to discuss the matter and told me to talk to PDC direct. I have submitted a financial disclosure and a lot of evidence, which they disregarded and now what to force me to sell my flat to pay this debt.

I believe you can only be charged an admin fee if it is reasonable and in your lease but I hope Bernie will advise you on that. That sounds very dodgy.

I initially rang the Rac legal servicesright from the onset. Which is free to speak to a solicitor. They acknowledge that this is the most complained thing re debt collectors plucking a figure from the sky and demanding it.so I know what they have demanded is totally unfounded.
Like I say I have had advice coming out of my ears.but unless I can get a solicitor to correct them on this they will push to court .if you google PDC the reviews are all negative .
I'm quite happy to pay for a one off solicitors letter to be written and sent to them.but unfortunately NO SOLICITOR will do a one off letter and I am left in fear of loosing my home.
This has dragged on since May last year and I can't take much more...sorry.

Ground rent is only due once a legal s166 notice has been sent. Likewise, if the lease allows, the administration charge is only payable once a legally correct demand is sent, which the correct Summary of Rights & Obligations.

Hi Nina

If you had a new landlord did they notify you of new ownership?Section 3 of the Landlord & Tenant Act 1985 does require a new freeholder to notify leaseholders of a change of ownership of the freeholder`s title, either by next rental payment date or within the next 2 months after the assignment of the freehold at the latest.

It is an offence not to comply with this requirment ,without reasonable excuse

Firstly carry out an online Land Registry search (only costs £3) and find out exactly who owns the freehold. And make sure you use the official Land Registry website a few dodgy ones can come up on Google.

They may say they had sent it but it was never received.along with 18 other flats who also never received the bill.surely they have to prove it was sent ,which when questioned could not provide

Beware! Land Registry is 4-6 months behind in updating ownerships so it could still show a previous owner

This case has been ongoing for 15 months .so I know who the landlord is.i did contact them once other leaseholders had received there bill and my debt collectors letter.they refused point blank to give payment details and a ref number. And said as I was in breach of contract, which they manipulated ,not to communicate with them. But to only discuss my issue with pdc.buying them more time to add further charges .
I have contacted Bernie .but no response as yet.
They keep threatening court action.in a way I hope they do .as I can present all this evidence of other leaseholders who never received a ground rent letter .complaints sent jointly and there underhand tactics in extracting money from leaseholders.
