Out on my ear after 25 years

I have been a private tenant for 25 years, living above a commercial premises.

Totally out of the blue 3 weeks ago we received a section 21 notice from our landlords solicitor. I would like to point out here that we have ALWAYS paid our rent, council tax and water rates.

Anyway, we have received this devastating blow, legally it appears we have not a leg to stand on but surely morals and fair play as well as common sense should prevail here?

I am not asking my landlord to allow us to stay, if he wants us gone then that is his decision, but I strongly feel that he should offer us something in the way of compensation.

1) How the hell am I supposed to pack up 25 years of my life, hold down a job and take care of my son who has a disability in just 8 weeks?

2) Why should I have to go to the expense of storage fees and removal fees, not forgetting to mention the hefty agents fees, deposits and so on I am expected to pluck out of thin air?

3) We have very recently (last 6 months) decorated throughout, new carpets and stuff and it leaves a very bitter taste that our hard works and efforts will be enjoyed by somebody else.

Am I being unreasonable do you think?

Regards

Nicola

Just prior to getting my section 21 The landlord sent someone here to inspect the premises.
Today i have recieved a letter from their solicitor asking for me to arrange an inspection with someone who is clearly a letting agent .

Reading through this thread, it appears to me that you have a freeholder, who is not your direct landlord, and a leaseholder (of the entire property i.e. the ground floor business accommodation and the upper floor which you are occupying) and that the lease of the combined premises is ending.

Your landlord (the business) has lease coming to an end and that business wishes to renew its lease, minus the part which you occupy, and the freeholder is requiring that in order to renew the lease on a different basis, the business needs to deliver back to the freeholder vacant possession of your flat, hence the current action. I am a Chartered Surveyor, familiar with business tenancies and whilst I shall not bore you with the legal issues, if my guesswork is correct, I understand entirely the reasons why the action is being taken. It is unfortunate that no one has shared with you the basis for it, but you are the person bearing the brunt of it.

If I am right, the situation is understandable and potentially there is an arrangement that can be made to sort it out. I am also based in Surrey and I would like to help you if I can, by talking to the parties involved and seeing what can be done. It may not be possible to keep you in your flat, but it might be possible to come to a financial arrangement or give you some additional time to sort yourself out with alternative accommodation. Without knowing all the facts or the individuals involved, I can't make any promises, but I hope at least that I can take some of the stress out of the situation for you.

If you would like to contact me, please ask Mark Alexander for my email address and we can go from there.

Best wishes, Freda

It sounds as if you have kept the flat in a good condition, so an inspection is just a matter of waiting around for a short time.

When does the section 21 end? It would seem to to be about now.

Indeed i have
I have no problem with an inspection as such , despite already having one 7 weeks ago, BUT what i DO object to is the taking of photographs .
Until such a time that a court order says i have to leave this is still my home
And that in my opinion is taking the proverbial .
