The head lease on a 2-bedroom flat that I rent out says: ‘Not to use or suffer to be used the Demised Premises for any purpose whatsoever other than as a private residence for occupation by a single household . . . ‘ Due to problem with some lettings, particularly those involving students, the management company are saying that they will now enforce this clause, meaning that no flat can be occupied by two or more ‘friends’.

This makes letting a 2-bedroom flat in an area where the overseas student market is the primary one somewhat problematical because I could presumably let only to a couple (whether married or not) or to two people who are related.

What is the definition of a single household in relation to a lease?

Btw for avoidance of doubt by single AST I meant all occupants on the same one AST for the whole property

Our Settlement Agreement at Mediation (just 3 weeks prior to the full blown Trial) has stated the result of our case, but this was accepted by the Defendant (our Board of Management) for our lease. Although open for all to read, it will not form any 'authority' for other's cases, but may help in that the Landlord for our 167 flats and their large firm of Solicitors were finally persuaded by our argument, if this is persuasive enough to be useful I'd happily share this document if you wish to write on me at: wendymcguinnes@aol.com

Hi Pip,

Our case was settled 'out of Court' at the Mediation phase prior to the Trial Date where our Management Company 'gave in' and agreed that one household in the lease can be interpreted as two or more unrelated individuals jointly renting a property on one AST. Does
