Council trying to claim my storage shed!

Hello, I bought my leasehold flat in 1999 from another leaseholder. At the time of purchase, the flat came with a storage cupboard in the entrance hall. The seller also offered to transfer a garage he was renting from the council and it was located at the back of the block. I declined the transfer of the rental agreement.

I’m currently renting out this flat, but using the storage cupboard for my personal use. The council has just sent me a letter telling me that they attended the property, broke into my cupboard, took photos of my stored items, riffled through my possessions invading my privacy, and then told me that if they don’t hear from me by the end of the month, they will remove everything and dispose of it!

They further said that the cupboard is available for rent. I have owned this with my flat for 24 years without having to pay a penny in rent. My leasehold expires in 87 years, so I still have ownership of this cupboard until then.

What do I need to do to prevent the council from emptying my cupboard and to get them to repair the lock?

Any advice would be welcome,

check the lease and the lease plan and if the cupboard was included with the flat then it will be in the lease and then send a copy of it to the council and demand they return your items and repair the lock / door or you will take legal action against them .

Councils can be bullies and need to be stood up to when they get things wrong which in my experience, they do .

As John Isaacs has said. Your Lease plan will detail exactly what you own. Most council blocks the storage cupboard, which was for your dustbin, is part and parcel of your property.
Also read the Report on Title written by your solicitor when you were buying the property.

Should the storage cupboard be part of your property then the Council could be charged with criminal damage and Trespass.

It actually doesn’t matter if you or your tenants utilise this cupboard.
