A council has been slammed for threatening landlords with an unlimited fine for failing to tackle fly-tipping.
Sefton council has warned landlords they must make proper arrangements for their tenants to dispose of rubbish until the designated collection day or face a fine.
The council warns on their website: “If landlords, or their tenants, don’t dispose of items correctly they could face Fixed Penalty Notices of up to £400 or an unlimited fine”.
Ben Beadle, chief executive of the National Residential Landlords Association (NRLA), has hit back at Sefton council, arguing a landlord can not be held responsible for a tenant’s rubbish.
Sefton Council says that landlords operating under selective licensing are required to provide tenants with appropriate facilities for waste disposal, including external storage areas for rubbish, wheelie bins, and refuse sacks.
Cllr Peter Harvey, Sefton Council’s Cabinet Member for Cleansing and Street Scene, warns they will come after landlords who are not meeting these requirements.
He said: “I have said before, fly-tipping is selfish, anti-social, potentially hazardous, and illegal.
“We will not tolerate it in Sefton, and we will come after culprits, and this includes landlords not meeting their requirements to their tenants and to the Borough.
“Sefton Council has to use resources to clean up. Sadly, dumping waste in our streets, alleys and green spaces means those resources could be better used on supporting vulnerable local people.”
Mr Harvey adds the council recently issued a £400 fine for fly-tipping and shared that there are many more cases in progress.
He adds: “We have recently issued a £400 Fixed Penalty Notice to a woman found to be responsible for a recent fly-tipping incident and there are further 15 similar, possible cases in the pipeline, so more people may soon be getting an unwelcome surprise visit from our Enforcement team and facing a hefty fine.
“I hope this makes clear that whoever you are, Sefton Council will not tolerate fly-tipping and if we identify that you are responsible for it, we will come after you.”
Ben Beadle, CEO of the NRLA, has slammed Sefton council for unfairly blaming landlords over fly-tipping.
In a social media post on LinkedIn, Mr Beadle said he fully supports local authorities tackling fly-tipping but slammed the idea that landlords should be held responsible for their tenants’ rubbish.
He said on LinkedIn: “I see it in the magistrates court routinely, and frankly this sort of selfish behaviour should attract the proverbial book being thrown at the perpetrators.
“But I am incredulous that a landlord is responsible for the tenants’ rubbish – making a further mockery of overreaching licensing regimes.
“Sure, provide appropriate bins and other measures but other than that, we are all responsible for our own behaviour.”
Mr Beadle adds landlords cannot control their tenants’ behaviour.
He adds: “I cannot control what my tenants do, they are responsible for their own actions and should face the consequences like everyone else.
“Why a landlord should carry the can is beyond me, other than it being an easy source of revenue once again, for overzealous local authority workers. Here’s a novel idea. Why not issue fines for non-compliant renters who directly cause said fly tipping?”

I’ve never had to do it, although I have had to clear up rubbish after tenants, including unsorted rubbish that the council would not collect, and rubbish strewn all over neighbour’s gardens.
So what kind of evidence would you need the council to provide you with in order to ensure an easy eviction?

Here we go again, some jumped up council “worker” has no idea how the real world works…just like this commie government we have now.
I have two of my properties in sefton, not under licencing though, if this ever happened to me I would take Harvey on and shaft him sideways in court.
A jumped up comment like this, “Cllr Peter Harvey, Sefton Council’s Cabinet Member for Cleansing and Street Scene, warns they will come after landlords who are not meeting these requirements.”
Let’s just see if the social housing in Sefton gets the same treatment….bet they have no gas safety or electrical safety certs in their council property…….

Interesting how Councils now want to make LLs responsible for tenants’ waste etc., but not to pay benefit claimants’ rent to LLs direct – as tenants need to take responsibility for their money themselves – irrespective whether they pass it on to LLs. Double standards anyone? And they wonder why LLs are leaving the sector…

This makes absolute sense if the Councillors are directly responsible for all other crimes in the borough to the extent they should be placed in prison as a result.

I had £600 fine from stoke on Trent council for an unopened parcel that was addressed to a student at my student house – that was found in a back alley
The fine was reminded because the student tenant had reported it missing to the agent prior to the date of the fine – it had been stolen from the front of the house.
Without that email evidence I apparently would have had to pay the fine.
On top of this unfairness, just doing my accounts and im struggling – I’m highly geared because I started portfolio 25 years ago with just enough money to buy my home – a 2 bed grotty terrace in one of the worst areas of stoke. So everything was mortgaged to the hilt. I still live in stoke on Trent where I look after my houses and tenants who have in the main been with me for 5-12 plus years. Section 24 has killed me – I’m selling as tenants chose to move – no one wants to leave me unless it’s to another of my houses.
I have to get money out by selling so I can keep afloat.
The threat of more ridiculous fines is tipping me over the edge – i have no pension – this was it!
I’m disabled always have been – I could have had a council house and been on benefits my whole life – but I have a different mentality – I’ve worked hard and contributed to our economy.
I’ve cried at the thought of having to evict my long term tenants – what the hell do the government and council want me to do?
I’m so tempted to blanket evict with section 21 and walk away 😭 Leaving over a dozen families homeless.
I genuinely think what they are doing boarders on criminal.

I had a letter from Newham Council a few years ago saying that they gave me one week to clean up the garden of a house in Stratford.
The funny thing was that the garden in my house was in a very good state except my builder had left 2 small bags of leaves in the corner of the garden.
I also had two young surveyors living there who looked after everything very well.
I thought there must have been a mistake because the gardens either side of the house were a mess.
On one side there was an elderly gentleman who threw his vegetables, potato peelings and other things into the garden and they were at various stages of decay and the other side was a tenant who had a sideline in selling 2nd hand furniture so I thought there must have been a mistake.
I phoned the council who did not believe me and when I asked what evidence they had they could not give me their evidence either.
Councils should be more responsible for their actions!

I’ve had a battle with a very wealthy “person/ Co” who built a 50+ room HMO but turns out to be single flats. They have blocked my access for years – they recently put a 1 tonne bag of sand, they’ve put barriers, fences, notes on cars and scared off a tenant and left me with a long void. Council still not sorted it after years of complaints. my tenants have identified who’s bins are on our properties .. mustering the courage to start a new complaint.. but sold all mine last fab HMO still to be sold. I’m just done.

So if a tenant parks on a yellow line, pops a speed camera, or robs a bank the landlord is responsible?
