Joint tenancy and both have skipped off

Tenant One has not paid £4,450 rent , tenant two owes nothing. Both are business professionals they claim. Both have left the property, have not a clue where they are! Both are on Social media.skipped

I had sent constant emails, phone calls asking rent arrears to be paid, tenant one promised, tenant two is upset that I have accused him.

I have issued an on line money claim, I just received the formal notification.

What next please?

    Hi Liza – to find these people should not be to difficult and then use Insolvency Legislation ASAP before it changes at the beginning of next month – though the outstanding rent due is almost at the new limit anyway.     Are they both joint and several tenants on the AST? If so, effectively they have both defaulted on the rent as they are both responsible for the full amount.

    If so, tenant 2, despite having paid their ‘share’ is still liable, so if that is pointed out to them, he/she may exert pressure on tenant 1 to pay up or just pay the debt him or herself to avoid further action.

    I suspect neither will wish to have a CCJ, as that will have a material effect on their future ability to rent, get credit or a mortgage.

    In your position, I would be stressing to both tenants the impact of their non payment and how it will impact their future.

    You will need to ensure that your MCOL reflects the correct tenancy arrangements.

    Are there any guarantors or a deposit or insurance policy to call on?

    Today the County Court Business Center has made a judgement in my favor, so now will try to get the court to take monies from their accounts. How long will this take?
