I have now had a response form Heather Wheeler MP, Minister for Housing and Homelessness, from my letter expressing the lack of justice in housing for landlords. You can read my points made in the series of readers articles below which started:

Letter to Gareth Johnson Member of Parliament for Dartford:

Dear Mr Johnson,

I’d like raise some concerns about justice, or rather the lack of it in Housing.

I operate my own business of recovering possession of mainly residential property for landlords who’s tenants have chosen to break their contract. Very similar if you like, to the criminals who choose to disregard criminal law, the defaulting tenants breach their contract (Tenancy agreement). There are only two options for a landlord to regain possession of ‘their’ property, despite the flagrant breach of contract which either through Section 8 of the Housing Act, or Section 21.

"Complaints about solicitors making spurious or fabricated claims should be directed to the Solicitors Regulation Authority."
Obviously this lady does not appreciate that you can only make complaint about your own solicitor. This brings the validity of the whole document into doubt.

Last December, in a debate about Section 21, Mrs Wheeler said

“The Government acknowledge that the end of an assured tenancy in the private rented sector can cause homelessness”

Even Shelter’s website acknowledges that this is not true. It is like saying that someone’s unemployment was caused by his dismissal. Its website gives the real causes of homelessness.

Where is Mrs Wheeler getting her advice from? Is it from Polly Neate, the CEO of Shelter, who keeps repeating the lie on television, most recently on last Monday’s Panorama programme?

I note that the gist of the document is still about the tenant - what they can/can't do, what the landlord has to do to provide a comfortable, secure and safe habitation. There's still very little about the landlord's ability to gain access to his property when the tenant has flagrantly broken the tenancy agreement by say just stopping paying the rent. Silence is golden in that respect. He probably doesn't even know the answer!

Shelter's web site might acknowledge it, BUT it didn't stop Polly repeating the claim several times on Panorama, which obviously wasn't picked up by their editorial team ( unsurprisingly )
